It will be great social work if some self proclaimed law expert will quote here, in which INDIAN LAW its allowed tht a married NON DIVORCED person is allowed live in relationship and its equal to the MARRIAGE😆😆 before posting the article i wrote a note tht its for people who can READ and UNDERSTAND, becoz i knew the reaction😉

Muktha jee that clearly talks about the child and we all agreed to that in some other posts based on taht shivani 's talk about the child being legal.

Here we are talking abotu marriage

Marriage its clearly illegal.

THe right is for the child not for the wife.

I do not think there is any LAW in india that without proper divorce , if the man starts living with another woman, she will also get the title of wife and be legal. That is not marriage.

we are not talking about jagya and gauri's child.

we are talking about gauri;s legality as wife.

THe law states she will get some rights

a) domestic violence protection
b) her child will be legal

No where it states she will be legal wife and the first marriage will be nulled !!!!

If that was the case, how easy it will be for men to escape from marriages!!!!???? I am sure india has not stooped this low!

@mukta_cute i agree that live -in relationship longer than 5 yrs. may b entitled 2 sum rts like domestic violence protection law & child's leaglity but it can't b legal as J hasn't divorced his 1st wife A. so his 2nd marriage is(if u want 2 term it ) illegal. so even this live-in relationship is also illegal!!
so plz don't always take the support of net or half-baked knowledge 2 make even wrong things (soically,morally & leagally) as rite one. bcoa in this forum many ppl've more knowledge as its proved during the J & G's illegal marriage while claiming J & A's marriage illegal bcoz of childmarriage!!

@suchi don't east in explaining. Anyway its go to waste. Becoz there is fix assumption, which u can't change. U know today we r enlightened tht u can't marry without divorce but if u will live in relation u can enjoy it as second marriage. 😉 😉 just enjoy such logic and interpretation of law but don't dare to argue. 😆 😆 😆

Dolly this provision is made to protect the rit couple who living for long time together and dont hv any proof of marriage like photos etc, so law recognise it as marriage. this is mentioned in my article, if people use to read and thn reply instead of replying with there set of reply for everything😉 law hs given some protection for the couple living in relationship BUT NO WHERE A MARRIED AND NON DIVORCEE person can be allowed by law to live in relationship and enjoy as second marriage😆😆 u know this provision even discourage live in relationship, becoz generaly this system people accept, becoz they dont want take responsibility. but giving rit to the couple make it useless, becoz if a person hv to bear the same responsibility as marriage, thn why not marry😆😆 and make it official😆

The Supreme court, held that Live-in relationship is permissible only in unmarried major persons of heterogeneous sex. In case, one of the said persons is married, man may be guilty of offence of adultery and it would amount to an offence under section 497 IPC. The Supreme Court held that a child born out of a live-in relationship is not entitled to claim inheritance in Hindu ancestral coparcenary property (in the undivided joint Hindu family) and can only claim a share in the parents' self-acquired property.

Gosh not again! Mukhta cute, what you are saying is a different case, let me put it straight.

1. A woman in a live in relationship gets equal rights as a wife: "
In January 2008, the Supreme Court validated long-term live-in relationships as marriages. A Supreme Court bench headed by Justice Arijit Pasayat with P Satasivan declared that children born out of such a relationship will no longer be called illegitimate. A recommendation by the Justice Malinath Committee to the Law Commission of India (2003) stated that if a woman has been in a live-in relationship for a reasonable time, she should enjoy the legal rights of a wife".
This law mainly protects women who are abandoned by their live in partners after a prolonged period of co-habitation, or are victims of domestic abuse.

2. But the fact is, this law only applies to men who are NOT married. If a married man lives in with another woman without divorcing the first wife, the second wife has no rights, Only the children get the rights to their father's property. The second wife only has the right to bring charges of fraud against the man by claiming she was tricked into the relationship with the promise of marriage. Other than filing a case against Jagya (under section 495 IPC) , Gauri has no legal rights.

There is a difference between any man living in with a woman and a MARRIED man living in with a woman. Polygamy is illegal under any circumstances under Indian Penal Code and there are no laws that support a man's multiple marriages. It is a different thing that only Anandi or her family can punish Jagya under section 494 IPC, but the fact remains that Gauri can NEVER be Jagya's legal wife until he divorces Anandi.

seriously ankit, zabardasti Jagya aur Gauri ki shaadi legalize kiya ja raha hai. Arrey agar unki shaadi legal hoti toh the court marriage would have sufficed na? The court document is a stronger proof of marriage than any proof of live in. But even the court marriage is illegal in this case, claims based on live in relationship right toh dur ki baat hai! 😆
