RULES FOR "THE SHORTCUT TO AUDITIONS - AMUL STAR VOICE OF INDIA" ("CONTEST")
The Contest will be held by as stated hereunder:
1. The Contest will be commence from May 1, 2007 at 9:00 a.m. and end on May 10, 2007 at 11:59 p.m.
2. Only the subscriber and the registered users of Hutchison Essar Telecom Limited ("Hutch") can participate in the Contest.
3. The person interested in participating in the Contest ("Participant(s)") must call from their Hutch mobile number to the number 123999 and on connecting sing a song.
4. On calling the number stated in rule 3 hereinabove, the Participant(s) would be given instructions so that the Participant(s) can record the song that the Participant(s) will sing during the call. The Participant(s) will also be asked personal details and the same would be recorded during the call.
5. The Participant(s) must follow all the instructions given to the Participant(s) during the call and must provide all and correct information asked during the call, failing which the Participant(s) entry in the Contest shall be null and void.
6. The Participant(s) can sing only Hindi songs. The duration of the song that the Participant(s) sings should be up to sixty (60) seconds. In the event, the duration of the song that the Participant(s) sings is more than sixty (60) second, then that part of the song which the Participant(s) sings beyond sixty (60) seconds shall not be considered while judging the voice of the Participant(s).
7. The song that the Participant(s) sings and the information to be provided by the Participant(s) should be audible and clear, failing which the Participant(s) entry in the Contest shall be null and void.
8. STAR India and/or the Producer and/or its representatives shall listen to hundred (100) randomly selected entries that are received during the Contest. STAR India and/or the Producer and/or its representatives shall select Five (5) Participant(s) ("Winner(s)) who STAR India or its representatives believe have the best voice among the aforesaid. The decision(s) of STAR India or it representatives regarding the Winner(s) of the Contest would be final and binding on all Participant(s).
9. The Five Winner(s) of the Contest would be eligible to directly participate in the Auditions of the program titled "Voice of India" ("Program") to be held in Lucknow ("Auditions") and would not have to wait in the queue for the Auditions.
10. The producer of the Program i.e. Sai Baba Telefilms Private Limited ("Producer") shall contact the Winners and inform them of the date of the Auditions.
11. Upon intimation from the Producer of the Program that the Winner(s) has won the Contest, the Winner(s) must furnish all the documents which the Producer or the representatives of the Producer(s) has requested from Winner(s). In the event, the Winner(s) fails to furnish the documents requested, the Winner(s) shall be disqualified and the opportunity given to the earlier Winner(s) to participate in the Auditions of the Program shall be forfeited.
12. In the event, the Winner(s) is a minor or a female, the Winner(s) can be accompanied by either one of the Winner(s)'s parent ("Companion").
13. All Winner(s) including their Companion(s) (if any) shall execute all such documents as may be required by STAR India and/or the Producer of the Program and/or their representatives.
14. In case the Winner(s) is a minor, the parent(s) of the Winner(s) shall, execute all necessary documents on behalf of the minor which shall be legal and binding on the minor. The parent of the minor Winner(s) shall accompany the minor to the Auditions.
15. In the event, the Winner(s) resides outside Lucknow, the Winner(s) shall be given one economy class air ticket to Lucknow and back to the city in which the Winner(s) resides. In the event, the Winner(s) is accompanied by a Companion as stated in rule 12 hereinabove, then the Companion shall also be eligible for the air ticket to accompany the Winner(s) from the city in which the Winner(s) resides to Lucknow for the Auditions and back to the city in which the Winner(s) resides.
16. The Winner(s) and if accompanied by the Companion shall be fetched from the airport on their arrival at the Lucknow airport and shall be taken directly to the place where the Auditions of the Program are being held. After the Auditions are completed, the Winner(s) and if accompanied by the Companion, both the Winner and his/her Companion shall be dropped at the Lucknow Airport to board the flight. All arrangements in connection to fetching and dropping the Winner(s) and his/her Companion shall be made by the Producer of the Program and all costs, charges in connection thereto shall be borne by the Producer of the Program.
17. All arrangements in connection to booking of the air tickets of the Winner(s) including the Companion (if any) to Lucknow and back to the city in which the Winner(s) resides shall be made by the Producer of the Program and all cost, charges in connection to thereof shall be borne by Producer. The Producer shall also inform the Winner and the Companion (if any) of the dates of travel and all necessary details in connection thereto. Any query or any dispute in connection to the aforesaid should be directly sent to the Producer of the Program and shall be directly settled between the Producer and the Participant(s) who has raised a query or the dispute. Neither STAR India nor any of the group companies or affiliates shall be responsible for the same.
18. In the event, the Winner(s) or his/her Companion (if any) is unable to travel on the dates informed to the Winner(s) or cannot participate in the Auditions of the Program in Lucknow, then the right of the Winner(s) to participate in the Auditions of the Program in Lucknow shall be forfeited and STAR India and/or the Producer of the Program and/or the representatives of STAR India shall be entitled to select an other Participant(s) and announce that person as the Winner(s) in place of the earlier Winner(s). The opportunity given to the earlier Winner(s) to participate in the Auditions of the Program without standing in the queue shall be transferred in favour of the Winner(s) replacing the earlier Winner(s).
19. The Participant(s) shall be charged Rs. 6/- (rupees six) per minute by Hutch. Any dispute in relation to the charges, billing of the calls or any issues regarding the network shall be directly settled between the Participant(s) and Hutch. Neither STAR India nor any of its affiliates nor its group companies nor its representatives nor the producer of the Program shall be responsible for any network problem or any issued connecting to the billing.
20. Save and except as stated in rule 15 and 16 herein above, all and any incidental costs (direct and/or indirect ), in relation to the travel, including but not limited to any STD/ISD/local calls and/or any other services used by the Winner(s) or the Companion (if any) during their travel in and to Lucknow, shall be borne by the Winner(s) or the Companion (if any) or the natural guardian and/or the legal guardian of the Winner(s). Neither STAR India nor any of its affiliates nor its group companies nor its representatives nor the producer of the Program shall be responsible for the aforesaid.
21. Neither the Winner(s) nor the Companion (if any) shall be allowed to change the airline that has been booked by the Producer. In the event, the Winner(s) or the Companion (if any) decides to deviate from the plan made by STAR India or the Producer or any of their representatives, then all cost, charges and expenses in connection to the travel and accommodation shall be solely borne by the Winner(s), the Companion and/or the natural guardian and/or the legal guardian of the Winner(s).
22. Neither STAR India nor the Producer nor their employees have given a guarantee and/or warranty etc. regarding the services to be offered by the airlines etc. and neither STAR India nor the Producer nor their employees shall be responsible for any reason whatsoever in connection thereto.
23. Neither the Winner nor the Companion (if any) nor the natural guardian nor the legal guardian of the Winner(s) shall raise any dispute with regard to the Contest including but not limited to the selection of the Winner(s) etc.
24. STAR India reserve the right to at any time to withdraw the Contest without giving any prior notice thereof.
25. Notwithstanding anything to the contrary stated herein, winning the Contest simply gives an opportunity to the Winner(s) of the Contest to, instead of standing in the queue to participate in the Auditions to directly participate in the Auditions of the Program. The Winner(s) would thereafter need to participate in the Audition(s), and if selected in the Auditions, in the further rounds of the Program. All Winner(s) must follow the rules and regulations for the Audition(s), and if selected, in the further rounds of the Program.
26. STAR India and/or the Producer and/or its representatives may hold the auditions of the Program(s) in other places. However, Winner(s) can directly participate only in the Auditions held in Lucknow. The Winner(s) cannot directly participate in any other audition(s) which are held in other cities by STAR India and/or the Producer and/or its representatives.
27. The Companion of the female Winner(s) and/or minor Companion(s) shall be solely responsible for the safety of the Winner(s) and shall at all times be with the Winner(s), take care of the Winner(s) and full fill all the needs of the Winner(s). The Companion and the parents of the Winner(s) shall at all time keep STAR India and/or their representatives indemnity in connection thereto.
28. Neither STAR India nor the Producer shall be responsible for the safety of the Winner (s) or his/her Companion (if any) in any manner whatsoever in relation to the Auditions and/or the Program.
29. STAR India reserves the right to change the date, time and place of the Auditions of the Program.
30. The song sung by the Participant(s) should be in good taste and not obscene, vulgar, libelous, defamatory, insulting, annoying, or which hurts the religious sentiments of any body, in any manner whatsoever. If found otherwise, STAR India reserves the right not to select the Participant(s) and no dispute of any nature whatsoever shall be raised by the Participant(s) in this regard.
31. The Participant(s) can participate more than one (1) time if the Participant(s) believes the Participant(s) can do better in another call.
32. By participating in the Contest, it shall be deemed to have construed that the Participant(s) has waived his/her right, either on its own or through any third person, to dispute, the decision(s) made by STAR India and/or the Producer and/or their representatives.
33. By participating in the Contest, it shall be deemed to have construed that the Participant(s) has agreed and consented that the film crew of STAR India or its representatives, shall have the right to film the Auditions and also use the footages of the Auditions. The Auditions so filmed and any materials including the footage shall vest in entirely in favour of STAR India, world-wide and in perpetuity, in any and all media, by and/or any medium, technology whatsoever without any money payable to the Participants.
34. The Winner(s) and his/her Companion (if any) shall maintain decorum during his/her travel to Lucknow and during the Auditions and follow all the instructions given by the representatives of STAR India and/or its representatives. STAR India and/or its representatives shall have the right to instruct the Participant to leave the Auditions for any misbehavior on the part of the Participant.
35. All the rights including all intellectual rights to the songs sung by the Participant(s) during the call and content recorded during the call made by the Participant(s) during the Contest, shall vest with STAR India worldwide and in perpetuity. STAR India shall have the sole right to exploit the same in any manner and in any medium as it deems fit.
General Rules
1. The Participant(s) should be citizens of India, residing in India to qualify for the Contest. The Participant(s) should be between the age of fifteen (15) year and thirty (30) years only.
2. In the event, the Participant(s) is below the age of 18 years, the Participant(s) can be accompanied by either of her/his parents. The Parent and/or the Companion shall be solely responsible in connection to the minor Participant and shall bear all the costs (save and except for the cost(s) relating to the air ticket and airport pickup), charges in connection to the participation of the minor Participant in the Audition(s) and/or the further selection procedure in connection to the Program.
3. The Participation of any participant below the age of 18 years, shall be construed that the Participant has participated, with the consent of its parents and/or legal guardian and that the parents and/or legal guardian shall be liable for all the obligations/ responsibility to be performed by the Participant. Any thing done by the Participant below the age of 18 years shall be considered to be done with the consent of the parent/legal guardian and by the parent/legal guardian.
4. Neither the Participant(s) or his parents or legal guardian, should not have criminal conviction.
5. Proof of age is a must for the Participant(s) and must be submitted to the STAR India and/or the Producer of the Program (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).
6. STAR India reserves all rights to make amendments to the existing rules and regulations without prior notice. It shall be the sole responsibility of the Participant(s) to check the rules and regulations for the Auditions on the website.
7. Non-conformance by any Participant(s), of the rules of the Auditions will disqualify that Participant(s), immediately, from participation in the Contest including the Audition, as the case may be.
8. The Winner(s) cannot exchange the opportunity to participate in the Audition(s) of the Program for items and/or for cash.
9. The participation of the Participant(s) in the Contest shall mean that the Participants have given their consent to the film crew of STAR India to interview the Participant(s) and his/her family members and also ask questions pertaining to their private affairs and/or family life. The rights to the aforesaid film including the footages and any materials in connection to the aforesaid, shall vest in entirely in favour of STAR India, world-wide and in perpetuity, in any and all media, by and/or any medium, whatsoever without any money payable to me.
10. The Participants shall make himself/herself available from time to time and co-operate with STAR India or its representatives and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever without any money payable to the Participant(s). Further, the Participant(s) shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. All rights to the footage of any nature with regard to the Promotional Activity and/or the Contest shall vest with STAR India, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity, in any and all media, by and/or any medium and/or technology.
11. STAR India and/or its representative shall have the right to exploit the Contest and/or the Auditions and/or the Program and any material in connection to the Audition(s) and/or the Program including but not limited to any footages relating to the Participant(s) and/or his/her family, by any and all means throughout the world and shall have the right to syndicate, license to third party, edit, cut, translate, dub, package or alter the same, and to combine them with other material for any purposes. Further, STAR India and/or its representative shall also have the right to edit, alter and modify the materials in connection to the Contests, the Auditions and/or the Program to the extent necessary for scheduling, technical purposes and censorship approval provided that such editing shall not, so far as possible, impair the integrity or quality of the Contest(s), the Auditions and/or the Program.
12. Irrespective whether the Participant(s) is short-listed or not, all intellectual property rights including but not limited to any other rights, of any nature whatsoever, known now or which may come into existence in future, from time to time, via any media, medium and technology, in relation to the footage, Performance Promotional Activity or the Auditions, shall vest with STAR India, for worldwide and in perpetuity.
13. STAR India reserves the right to cancel the entry of any Participants including after the Participant is announced the Winner(s) of the Contest. For avoidance of doubt, the disqualified Participants agrees that all the intellectual property rights in and to the performance shall continue to vest with STAR India for worldwide and in perpetuity, without any consideration payable to the disqualified Participants including the Winner(s).
14. No dispute of any nature whatsoever, with regard to the selection procedure of the Contest or the Auditions, shall be raised by the Participants and/or any family member(s) of the Participants.
15. The Participant(s) shall do any and all acts and execute any and all documents in such manner and at such location as may be required by STAR India in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to STAR India herein. In the event, the Participant is below the age of 18 years, the parents and/or legal guardian of such a Participant shall do any and all acts and execute any and all documents in such manner and at such location as may be required by STAR India in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to STAR India herein
16. The Participant(s) agrees that he/she shall hold harmless the STAR India, its affiliates, its group companies, the Producer, their employees, officers, or any other person in relation to Contest and/or the Auditions form any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Contest and/or the Auditions and waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the person named above, to claim any damages or reliefs.
17. STAR India or its representatives reserve the right to stop/discontinue the Contest(s) or the Auditions, for any reason whatsoever, any time it deems fit without any prior notice in connection thereto. In the event, the Contest or the Auditions are discontinued for any reasons whatsoever; STAR India and/or the Producer or their representatives shall be responsible to compensate the Participant(s) or shall be responsible for any arrangements made in connection thereto. Neither STAR India nor the Producer nor any of their representatives shall be responsible to inform the Participant in advance, in the event, STAR India decides to discontinue the Contest and/or the Auditions.
18. Neither STAR India nor the Producer nor any of their representatives shall be responsible in any manner whatsoever, for any injury, death, mental trauma caused to the Participant(s) or the Companion (if any) in any manner whatsoever, in connection to the Contest and/or the Auditions and/or the Program.
19. Employees of STAR India, Producer of the Program, advertising agency, which has been appointed from time to time, and also employees of the main sponsors; and members of their immediate family cannot participate in the Contest.
20. STAR India reserves the right to disqualify a Participant(s) incase a discrepancy is found to exist in the information furnished/provided/stated by the Participant(s) during the conversation with STAR India and/or the Producer and/or the representatives and in the information(s) stated in the documents furnished by the Participant(s).
21. The participation of the Participants in the Auditions shall mean that the Participants has read, understood, accepted and agrees to abide with all the rules including the general rules of the Auditions.
22. STAR India may in its sole discretion exclude a contestant(s) from participation in the Contest which may include without limitation (i) circumstances which, in STAR India's view, renders the contestant(s) unfit to participate therein; (ii) inability to produce documentation required by STAR India and/or its representatives in the rules and/or at any given point of the time. STAR INDIA may in its sole discretion exclude a Companion from accompanying the Winner(s). Upon receipt of such an notice from STAR INDIA and/or the representatives, the parent(s) shall immediately replace the Companion with another companion.
23. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by STAR India and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. The cost, charges and expenses including legal expenses shall be solely borne by the Participant(s).

28. Neither STAR India nor the Producer shall be responsible for the safety of the Winner (s) or his/her Companion (if any) in any manner whatsoever in relation to the Auditions and/or the Program.
29. STAR India reserves the right to change the date, time and place of the Auditions of the Program.
30. The song sung by the Participant(s) should be in good taste and not obscene, vulgar, libelous, defamatory, insulting, annoying, or which hurts the religious sentiments of any body, in any manner whatsoever. If found otherwise, STAR India reserves the right not to select the Participant(s) and no dispute of any nature whatsoever shall be raised by the Participant(s) in this regard.
31. The Participant(s) can participate more than one (1) time if the Participant(s) believes the Participant(s) can do better in another call.
32. By participating in the Contest, it shall be deemed to have construed that the Participant(s) has waived his/her right, either on its own or through any third person, to dispute, the decision(s) made by STAR India and/or the Producer and/or their representatives.
33. By participating in the Contest, it shall be deemed to have construed that the Participant(s) has agreed and consented that the film crew of STAR India or its representatives, shall have the right to film the Auditions and also use the footages of the Auditions. The Auditions so filmed and any materials including the footage shall vest in entirely in favour of STAR India, world-wide and in perpetuity, in any and all media, by and/or any medium, technology whatsoever without any money payable to the Participants.
34. The Winner(s) and his/her Companion (if any) shall maintain decorum during his/her travel to Lucknow and during the Auditions and follow all the instructions given by the representatives of STAR India and/or its representatives. STAR India and/or its representatives shall have the right to instruct the Participant to leave the Auditions for any misbehavior on the part of the Participant.
35. All the rights including all intellectual rights to the songs sung by the Participant(s) during the call and content recorded during the call made by the Participant(s) during the Contest, shall vest with STAR India worldwide and in perpetuity. STAR India shall have the sole right to exploit the same in any manner and in any medium as it deems fit.
General Rules
1. The Participant(s) should be citizens of India, residing in India to qualify for the Contest. The Participant(s) should be between the age of fifteen (15) year and thirty (30) years only.
2. In the event, the Participant(s) is below the age of 18 years, the Participant(s) can be accompanied by either of her/his parents. The Parent and/or the Companion shall be solely responsible in connection to the minor Participant and shall bear all the costs (save and except for the cost(s) relating to the air ticket and airport pickup), charges in connection to the participation of the minor Participant in the Audition(s) and/or the further selection procedure in connection to the Program.
3. The Participation of any participant below the age of 18 years, shall be construed that the Participant has participated, with the consent of its parents and/or legal guardian and that the parents and/or legal guardian shall be liable for all the obligations/ responsibility to be performed by the Participant. Any thing done by the Participant below the age of 18 years shall be considered to be done with the consent of the parent/legal guardian and by the parent/legal guardian.
4. Neither the Participant(s) or his parents or legal guardian, should not have criminal conviction.
5. Proof of age is a must for the Participant(s) and must be submitted to the STAR India and/or the Producer of the Program (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).
6. STAR India reserves all rights to make amendments to the existing rules and regulations without prior notice. It shall be the sole responsibility of the Participant(s) to check the rules and regulations for the Auditions on the website.
7. Non-conformance by any Participant(s), of the rules of the Auditions will disqualify that Participant(s), immediately, from participation in the Contest including the Audition, as the case may be.
8. The Winner(s) cannot exchange the opportunity to participate in the Audition(s) of the Program for items and/or for cash.
9. The participation of the Participant(s) in the Contest shall mean that the Participants have given their consent to the film crew of STAR India to interview the Participant(s) and his/her family members and also ask questions pertaining to their private affairs and/or family life. The rights to the aforesaid film including the footages and any materials in connection to the aforesaid, shall vest in entirely in favour of STAR India, world-wide and in perpetuity, in any and all media, by and/or any medium, whatsoever without any money payable to me.
10. The Participants shall make himself/herself available from time to time and co-operate with STAR India or its representatives and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever without any money payable to the Participant(s). Further, the Participant(s) shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. All rights to the footage of any nature with regard to the Promotional Activity and/or the Contest shall vest with STAR India, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity, in any and all media, by and/or any medium and/or technology.
11. STAR India and/or its representative shall have the right to exploit the Contest and/or the Auditions and/or the Program and any material in connection to the Audition(s) and/or the Program including but not limited to any footages relating to the Participant(s) and/or his/her family, by any and all means throughout the world and shall have the right to syndicate, license to third party, edit, cut, translate, dub, package or alter the same, and to combine them with other material for any purposes. Further, STAR India and/or its representative shall also have the right to edit, alter and modify the materials in connection to the Contests, the Auditions and/or the Program to the extent necessary for scheduling, technical purposes and censorship approval provided that such editing shall not, so far as possible, impair the integrity or quality of the Contest(s), the Auditions and/or the Program.
12. Irrespective whether the Participant(s) is short-listed or not, all intellectual property rights including but not limited to any other rights, of any nature whatsoever, known now or which may come into existence in future, from time to time, via any media, medium and technology, in relation to the footage, Performance Promotional Activity or the Auditions, shall vest with STAR India, for worldwide and in perpetuity.
13. STAR India reserves the right to cancel the entry of any Participants including after the Participant is announced the Winner(s) of the Contest. For avoidance of doubt, the disqualified Participants agrees that all the intellectual property rights in and to the performance shall continue to vest with STAR India for worldwide and in perpetuity, without any consideration payable to the disqualified Participants including the Winner(s).
14. No dispute of any nature whatsoever, with regard to the selection procedure of the Contest or the Auditions, shall be raised by the Participants and/or any family member(s) of the Participants.
15. The Participant(s) shall do any and all acts and execute any and all documents in such manner and at such location as may be required by STAR India in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to STAR India herein. In the event, the Participant is below the age of 18 years, the parents and/or legal guardian of such a Participant shall do any and all acts and execute any and all documents in such manner and at such location as may be required by STAR India in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to STAR India herein
16. The Participant(s) agrees that he/she shall hold harmless the STAR India, its affiliates, its group companies, the Producer, their employees, officers, or any other person in relation to Contest and/or the Auditions form any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Contest and/or the Auditions and waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the person named above, to claim any damages or reliefs.
17. STAR India or its representatives reserve the right to stop/discontinue the Contest(s) or the Auditions, for any reason whatsoever, any time it deems fit without any prior notice in connection thereto. In the event, the Contest or the Auditions are discontinued for any reasons whatsoever; STAR India and/or the Producer or their representatives shall be responsible to compensate the Participant(s) or shall be responsible for any arrangements made in connection thereto. Neither STAR India nor the Producer nor any of their representatives shall be responsible to inform the Participant in advance, in the event, STAR India decides to discontinue the Contest and/or the Auditions.
18. Neither STAR India nor the Producer nor any of their representatives shall be responsible in any manner whatsoever, for any injury, death, mental trauma caused to the Participant(s) or the Companion (if any) in any manner whatsoever, in connection to the Contest and/or the Auditions and/or the Program.
19. Employees of STAR India, Producer of the Program, advertising agency, which has been appointed from time to time, and also employees of the main sponsors; and members of their immediate family cannot participate in the Contest.
20. STAR India reserves the right to disqualify a Participant(s) incase a discrepancy is found to exist in the information furnished/provided/stated by the Participant(s) during the conversation with STAR India and/or the Producer and/or the representatives and in the information(s) stated in the documents furnished by the Participant(s).
21. The participation of the Participants in the Auditions shall mean that the Participants has read, understood, accepted and agrees to abide with all the rules including the general rules of the Auditions.
22. STAR India may in its sole discretion exclude a contestant(s) from participation in the Contest which may include without limitation (i) circumstances which, in STAR India's view, renders the contestant(s) unfit to participate therein; (ii) inability to produce documentation required by STAR India and/or its representatives in the rules and/or at any given point of the time. STAR INDIA may in its sole discretion exclude a Companion from accompanying the Winner(s). Upon receipt of such an notice from STAR INDIA and/or the representatives, the parent(s) shall immediately replace the Companion with another companion.
23. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by STAR India and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. The cost, charges and expenses including legal expenses shall be solely borne by the Participant(s).
