The NRI businessman protested to the chatter of the actor and his friends following which Saif threatened him and punched him in the nose, fracturing it.
Saif, on the other hand had said in his statements that the businessman made provocative statements and used abusive language against the women accompanying him (including Kareena Kapoor and her sister Karisma Kapoor) which led to the spat.
Though the three were later released on bail, the Court framed charges against them under Sections 325 (assault) and 34 (common intention) of Indian Penal Code in which they have pleaded innocence.
The court on March 19 had asked Saif to remain present today as the complainant was to depose against the actor. However, Khan's lawyer filed an exemption application saying the actor could not make it as he was shooting abroad for an ad film but gave an assurance that the actor will remain present on the next hearing.
The prosecutor Wajid Sheikh objected to the application and sought issuance of warrant against Saif. The court said if the actor did not come the next time, a warrant may be issued against him.
The next hearing would commence on June 18.
