Actually I am different from all this, me and my sisters carry our mother's name as surname while my brother carry father's name. Same goes to my mother and anuts. It was as if telling us as a daughter carry forward your mother's legacy. It may be due to the travancore royal family which follows matriarchal tradition. Here ruler's sister was given the power of queen not rulers wife. Even rulers sister's first born son was the heir... They still follow this.

Till now ar mom not accepted in story made as sautela or another woman wife by dadi. As ar kid is going to come soon the status is coming now for shivani. If madhav accepted strongly before dadi this issue could not have come.

I want to ask one thing. Why abheera is never said as poddar till now even though she is married in all sorts of traditions. What's the need to keep only sharma name. Why can't they say abheera sharma poddar? So if abheera kids come in story what surname they get next? Poddar or sharma or any other new invented surname for convenience

Even after changing her legal status to be alive she will not automatically reclaim marital status and need to file a case in court.

But even then, the court will most probably favor Vidya because 1. She was married to Madhav and stayed as his wife for 30 years, 2. There is no evidence to prove that Vidya knew that Shivani was alive when she got married to Madhav and for all these years too.

This is going to create a legal and moral dilemma so most probably what is going to happen is that Vidya will retain her marital rights and she will be declared to be the valid, legal and legitimate widmfe whereas Shivani will only get financial compensation.

But then again, this is an ITV serial, yahan kuch bhi ho sakta hai bas sensible baat nahi ho sakti

Yes this is xactly what happens, i think there is a case of a army person who was thought lost in conflict ( english case law - which became the basis for that 7 year law) can't recall now

@red Vidya's marriage to already married Madhav is illegal, Shivani was alive, didn't disappear even for years, when they got married. It's clear bigamy, Madhav woke up from coma/unconscious state after accident and KP got him married to Vidya showing him death certificate of Shivani. Kaveri Poddar who is a witness to their marriage was also a witness to Shivani being alive. Conjual relationship even for 50 years in illegal marriage doesn't turn it to legal.

But court will look at the filing person that is vidya ..she did not know madhav wife was alive ( they have to prove with credible evidence if they think otherwise) and she has spent 30 years with madhav sa to whom she was married publicly.. plus madhav also did not know since he saw the death certificate. So like Sonali said vani have to revoke the death certificate and then claim

Until some changes have happened in past decade..the Hindu law is clear no child is illegitimate.
