BC case can be fought separately by Abhimanyu, the manner in which husband and wife divorced comes into picture.

If his lawyers prove name change from Abhimanyu Birla to Abhinav Sharma was done on purpose to hide his son's identity then yes punishable by law. It amounts to forgery with intention to deceive.

Inka case complicated hai

Akshara can plead on humanitarian grounds, emotional abuse, trauma etc.

Subsequently Abhir's inheritance cannot he claimed in case father dies without a will,

There's absolutely no proof of AB being Abir's dad, Technically BC still has Sharmaji since madam tore originals in the hospital

Suppose it was captured on camera then liable for forgery.

When so much money is at stake in normal cases bio father's name should be mentioned.

How does the link you shared have any context to the situation shown in the show also it's a question asked on website, there r actual full case studies you might find online with proper verdicts I think those would be better reference than questions asked on such sites because they might throw light on what exactly happened

Wrong. It’s actually a crime to add any random name. The said random person must legally adopt the child even if he is a step father. And there are couple of more stupidities involved in this case. I don’t think AK married Nav before Abhir’s birth. So he was first legally linked to them illegally via the Birth Certificate and then they probably registered their marriage. So he wasn’t a stepfather at the birth time. The reason for legal adoption first has so many advantages.. the child is lawfully protected to ensure financial stability, protected against abuse or harassment!! Nav turned out to be a good person. If he was a pyscho, AK would have been grilled and roasted by Goenkas

One thing we all ignore is it's just not about BC. All Abhir's legal documents have the wrong father's name.

He can be his father emotionally. But legally Abhimanyu is his father which Akshara hid and forge all the legal documents of Abhir so that's why judge said to initiate an inquiry

Legally speaking:

1. Akshara and Abhimanyus divorce legal (assuming all the legal aspects took place BTH)

2. Akshara and AbhiN marraige is legal (with her divorce with Dr Birls valid)

3. Post kids birth, AbhiN should have legally adopted Abhir. Here they would have required a NOC from bio father since bio father is known and still alive. For other adopted kids, it is not required as bio parents are not known.

4. Post adoption you can write the step father's name in BC

5. Best option for a single/ divorced mom is to keep father's name blank. As she is not required to disclose it.

6. Akshara here need to fight a case with soild reason why she is not at fault. A good lawyer should be able to but this is reel, so let the case rest here. And just see what writers give us.

Legally he can be if Abhimanyu give a NOC that he wants to nothing with his son and doesn't want him to inherit his property.


One of the reason that Father's name must be correct is also inheritance.
