So I just read that Gujrat High Court decision about sex with wife without her consent is not rape. There has been some really good movies about this awareness like Lipstick under my burkha, The silence, akashvani, parched etc but there has also been equally pathetic movies like Raja ki ayegi baraat, Mehendi, Dil dhadakne do etc.

Isn't this one step forward and two steps back?

When rape or harassment by a stanger is hardly recognized as such. How can marital be more than a mere notion?

They'll think that the husband by the bond of marriage has a right to have intercourses with his wife even if doesn't feel like it and that she'll just have to lie there if she's that tired.

Most often than not, policemen and policewomen are no better than the other citizens.

The movies you mentionned were artsy movies which -aside from winning awards and being screened at various Festivals- won't make an impact on society.

I find this interesting exerpt on a website :

Can you refuse to have sex with your husband? Is there a law on marital rape?

Since India does not have a law on marital rape, even if a woman's husband has sexual intercourse with her without her consent, he cannot be prosecuted for rape. However, excessive and unreasonable demands for sex, or demands for unnatural sex have been considered forms of cruelty and may entitle a woman to a divorce.

If a woman is judicially separated, her husband cannot have sexual intercourse with her without her consent. If he does, he can be prosecuted under section 376-A of the IPC. Note that consent under pressure (e.g. because of threats to injure or to stop paying maintenance) is not considered valid.

What can a woman do to prevent domestic violence?

One option is to get the woman's husband to execute a "bond to keep peace", or a "bond of good behaviour" through the Executive, Magistrate who can order the husband to put a stop to domestic violence. The husband can also be asked to deposit securities (i.e. money or property) that will be forfeited if he continues to act violently. ?

So basically, they weren't in the wrong when they ruled out the marital rapes charges. It's the law that has to be changed and for this to be changed, politics have to take interest in this.

People's mindset have to change to as to bring this change forward.

The police about marital rape (France) :

#payetaplainte : Entendu devant la plaignante victime d'1 viol conjugal (oui a existe) auditionne : "Vous voulez divorcer ! Mais il faut bien manger ! C'est dur d'tre une femme seule n'ayant pas boss depuis 10 ans ! Comment allez-vous vous dmerder ?"

"Are you sure you want a divorce? You have to eat too. It's difficult when you're a woman without support who hasn't worked for 10 years. How will you manage?"

If in France (the country of Human rights) this subject is dealt with such lightness by the police that it wouldn't surprise me if it wasn't any better in India.

India like a lot of countries came a long way -and quite quickly- when it comes to woman's rights but for it to reach every social strate and sustain it'll take time.

Laws have to be made, enforced and most importantly, mentalities have to change.

Sex should be a mutual thing. If one party is not interested then it is rape.

I am waiting for the law to be changed.

One of the weak points of our law.

People give comments like if you don't want sex , why did you get married. I mean W*F.

They did not get married just to have sex or be raped. Marriage is beyond that. It is about companionship

+1000 it's absolutely gross. I dated a guy who said if we are married we will have sex whenever he wants because we would be married. That's a a big deal breaker for me to end a relationship if you think that way. 🤢

Well, the same judgement also stresses on how the legislature needs to come up with a law stating forced marital sex as rape. It's just that there's no such law right now.

Marital Rape is a very complex issue. A rape is having sexual intercourse with someone without his/her consent.

In other rapes, the consent is not there because he/she doesnt want to have intercourse with that particular person

But after marriage, the consent may be not there for 2 reasons - Either he/she doesnt want to have intercourse

1. with that person(Like in normal Rape) ever
2. only at that particular Time (maybe because they are not in mood but loves him/her)

If its the 2nd reason then its difficult to be called as a rape(But dont know what to call it either)

Also the big reason for not making it a punishable crime is that a person may misuse this law by falsely claiming of rape and there will be no prove to support any claim from either parties !!

why can't it be rape? if the guy forcefully has sex with his wife or any other girl, it is rape.. a wedding vow doesn't mean she is reduced to a doll...

also if she isn't in the mood for it then it will also be physically painful, so any guy that does it is an asshole and has no regard for his "wife's" well-being..
