I am posting this on behalf of Miss Cherie since she cannot create threads due to her

WL.

I have a query regarding the new WL rules. See, I have received a WL raise from Cool

Viewbie . .~Saraa~ on the 20th of March this year. And I had PMed her to take my WL

off on June the 3rd and got a reply from her saying that my 3 month period gets over

on June the 20th and I should expect a PM regarding this issue after the 20th. I

waited for 6 days after that date and got no response from her, so I decided on

PMing her about it again.

She responded, saying that my WL raise from her cannot be lowered because I have

received a WL increase in between. Now this WL increase I got from you was on June

22nd, which is 2 days after my 3 month period got over. And according to the new

rules which state:

It says that a member can only get their WL reduced after 3 months if they have

received no new warning increase in the 3 month time period. So according to this, I

should get my WL reduced or not? Because the WL increase I have received was after

2 days my 3 month period ended for the WL raise I was issued by ~Saraa~. So I don't

understand why it's being taken into account here? I also have another question

regarding the new rules about WL. Do the new rules get taken into consideration if a

member received their WL before these rules were put into place?

If I am misconceived about these rules, please do clear my confusion. I will be

waiting for your response.

Now that you have gone public with this, I hope you won't mind with me sharing the facts.

You PMed me on June 3rd and I replied on June 6th telling you that there was still time until the 20th, therefore you'll have to wait. I also did tell you in the PM that I was traveling due to which I will not be checking my PMs and to expect a PM from the IPKKND DT after the 20th. Now, I got back on the 22nd, and did NOT login into India-Forums right away because I also happen to have a personal life, but as soon as I logged in, I checked your PM which was from June 25th stating that your period has ended and that the WL should be decreased. I replied to you right away on June 26th telling you that I needed time to talk to the admin and the higher DT which I did. And I was told that the rules applied no matter what the circumstances may be. The new rule says:

My main concern being with the above underlined and bold text. My only reason to not lower your WL is that the rules have been implemented starting June 20th, which is also the date when your 3 month period ends.

So, if the rules are being implemented on the other members, then why the exception for you? The rules were enforced starting June 20th, and that is when your period ended, however, that does not mean that the new rule won't apply to you.

The final call is upon the admin himself. If he wants me to lower your WL, then I will. But this will also raise the issue of the other members who want their WL lowered based on solely the reason that their WL was raised before the new rules came out.

Legally speaking (assuming you've no knowledge of the legal framework whatsoever), all policies are subject to be implemented 'prospectively' rather than 'retrospectively'. If the new global rules were made on ( or after the date) of the expiry of the three month period, it should have no effect on the earlier warning levels as the period has already expired and unless stated otherwise, all the rules are effective from a date somewhere in future.

Moreover it's quite evident from your earlier reply to the member concerned in question, where you committed to decrease their warning level without giving a disclaimer about any decision being subject to a change with a new policy, not only you were negligible to assure member of a warning level decrease without restricting your liability owing to new rules which could have been anticipated by any reasonable DT member in your place but you've also breached your assurance. As a DT member you should have included a disclaimer that decision to lower her warning level not only depends on the given date and time period but also subject to any changes in policy, should there be any.

It would have been unfair for members if MissCherie's warning level was lowered but since the rules are effective prospectively rather than retrospectively and you emphasised on the 'days' to expiry of the time period rather than addressing and taking into contemplation the fact that all warning level decrease are subject to any subsequent modifications in IF policy manual, I believe that MissCherie's warning level should be decreased as committed. Back in 2006, I was asked to join the DTs. Unfortunately owing to time constraints, I couldn't back then. However if I were a DT member, I wouldn't have been pretty negligent with my PM replies concerning warning level matters just to avoid any later complications and ambiguity.

Saara.. by considering your post, now decrease my WL right now.. Because I am facing that WL issue since 6 years.. Remove my WL now.. I have not received any WL since like 1 year so u can easily remove my WL .. remove it now.. !

I feel there is no consistency in dishing out WLs.. I questioned my comments been deleted without knowing the reason and I was slapped with a WL. I really am confused as a forum is a place where folks can excercise their rights of Freedom of speech/ expression , however this does not seem to be the case here... Members that agree with what ever is posted and those that the post on certain people's favourite artists are never penalised even they are abusive and down right rude to others! In terms of folks critising admin, DTs, Vijay well my stance they should reflect on what has been said and come up an action plan to improve relationships instead of slapping WLs left, right and centre!!!

Am I missing something here? Since a WL has to be removed after a 3 month period, MissCherie's should have been removed on the 20th of June. Even if the Mod in question was understandably unavailable, she must know that the WL received AFTER the 20th of June should not be a hindrance in decreasing the WL she gave 3 months before. She may have checked the PM afterwards but the rule does not apply because MissCherie received a further WL on 22nd June, which does NOT fall within the 3 months period.

And Vijay, I'm still waiting for you to outline the criteria of judging the amount of WL to be given on a certain derogatory post. Because honestly, it seems as if you have been giving WLs in accordance with the NUMBER of posts that break any rule rather than the EXTENT to which the person has broken the rules.

For instance, Person A makes a post calling some member a "hypocrite" and Person B makes a post wishing death upon some member's family...and both get the SAME WL, then obviously I need not mention how very unfair that would be.

Since the member did not violate rules in that three month period ...as per the policy the members warning level has to be removed. It's not fair with what happened to miss cherie and DT shud comply to policy.

I can't believe some Mod will get this petty cuz of some personal vendetta, and no don't tell me otherwise cuz it's obvious her WL should be decreased from the dates which has been mentioned unless there is some personal grudge going on. But because of whatever so called history, the Mod in question is disapprovingly using her authority and giving hard time to members like MissCherie for a thing like WL which is her right to get it reduced based on the rules. This is what happens when Mods do not act neutral and mix their so called professional and personal equation with members of IF.
