How come judge starts the proceedings without both lawyers present?

If Abhi takes the case over from the other vakeel that met with Shamu y'day he should know by now that Prats is the daughter of Sax family. Wouldn't he wonder why she'd defend her husband IF he is the one who killed her brother?

How come defendent, his wife, the inspector...they all get to butt in and say what they want? This judge had loads of patience.
