Inorder to activate the will, ASR need 2 die.
But personally, i do believe dat the kidnapping incident is Arnav's own idea. If so, then the will is at question.

The WILL
Did ASR purposely make a WILL(fake) to mislead Shyam?
My point is: Why didn't he directly make a Transfer deed (a secret one) as he knows that Shyam is after his property?
If he has transfered the property to someone else(very reliable person)-- the problem will be half solved,
because the WILL in Shyam's hand, and the second will he's made Kushi take ASR's signature will be of NO USE- if ASR is not the owner of the property.
I don't know whether it is the same in Indian Law, but in Roman-Dutch Law --- The transfer deeds must be signed by the both parties as the WILL doesn't require so.
*Did ASR purposely made a WILL to catch SMJ into his snare?
*Has he already trasfered all his property through a Trasfer deed to some one else
(1.Most probably Akash, as he won't have any doubt in sighing to any document ASR says,
2.If he has revealed some truth to Naani or Mamaji- there is a possibility to them to sign ,which I don't think ASR was open enough to share with them
3.And even he can make the unborn child as the owner of the property , keeping some trustworthy person as his gurdian till the baby is 18years old-- there is a possiblity that Akash has signed this sort of a document blindly --refer point1)
If it is the 3rd point may be ASR's brain has hit two birds with one stone, as the unborn child owns the property --who is after the property has to save the child's life first and even has to wait until she turns 18!!!
So, what I felt was there was NO WILL at all, it was just ASR's plan in misleading and testing Shyam. THE WILL WAS A DRAMA???
On the other hand, if someone wants to become the sole owner through a WILL, there is no use of just kidnapping ASR and keeping him alive so long , as the WILL will be activated only after his death ( exceptions : only if not if takes some time to complete the legal registration of a WILL, which I am not sure needed or not according to Indian Law)
