What are Mamta's rights?

The National Guidelines have elaborately laid down the suggested law. It does not consider the surrogate to be the legal mother under any circumstances.

In circumstances where the surrogate donates her ova, the child shall have to be legally adopted by the infertile couple. Only then can they become the legal parents which shall be appropriately recorded in the birth certificate of the child.


To avoid misunderstandings, the National Guidelines have strictly stated that once the child is formally adopted by the Commissioning parents, the third party donors and the surrogate must surrender all parental rights as regard the child, in writing.

Please note these are applicable to INDIA only.

Now the ques is how will Mamta get Krish? What right does really have to fight a case?

seriously, i mean serials are always showing the wrong thing and are avoiding da law. so,legally akshay and tanisha r da parents of krish, right? i dont get why mamta is fighting 4 krish. she doesnt have a right 2 him anymore.

shes fighting becuz akshay didn't know bout the surrogation he didn't decide to adopt the child. mamta has the right to take krish back cuz she only gave krish to tanisha and when tanishe is out mamta is defenately has the right to take him back. mamta didn't sign the papers to akhsay

A birth certificate must have been prepared for 'Krish' and that would bear Akshay and Tanisha's name.The birth certificate cannot be in the name of a surrogate mother and Genetic father.

ALthough it is a serial but it involves a child, and in India like elsewhere in the world, children are an highly emotive issue esp amongst women. Most women desire a child in their life's including single women who do not wish to marry but have desire to have a child. There are women who may not be in reproductive age or unable to bear are looking for surrogacy.

People get influenced by what's shown, even in my office, without awareness of the legal procedures involved. They are simply emotionally surcharged.

The concept of serial is good but somewhere the sensitive issue needs to be handled in proper light so that it is not misconstrued.

well Krish was never formally adopted...it was just implied that he is Tanish's son

well..lets look at it this way... they can always do a DNA testing, right? to find out who the real mother is.. and obviously mamta will have the same blood as Baby Krish..
