No, Abhira won't be prosecuted. She did not kidnap the child according to the law, because the child's father himself consented to the baby being in Abhira's care. If Ruhi decides to sue Abhira, pehle Rohit hi phasega because he didn't take consent from his wife. After that, it will be Armaan, and then Ab. Also, Abhira can claim temporary depression for her actions. The other two will be the ones who will have to face jail time.

As far as I understand the law, with a good lawyer, (not someone like Armaan) not only will the case be overturned, but Abhira can also countersue Ruhi for defamation of character lol.

Verbal consent of Rohit doesn't matter in India law iirc. Also it could be emotional manipulation in a sensitive moment legally too ruhi would get daksh

Instead of punishing them Ruhi became surrogate mom , gifted Abhira & Ar a baby but look at the way they are taking care ...

First Armoron kidnapped baby and absconded for 7 years , now when Maira is with them they are in to many other stuffs
