Krazzy 4 music is a copy, declares Bombay HC

In a major boost to music director Ram Sampath, the Bombay high court has upheld the fact that the music of Krazzy 4 is a copy.

Sampath had filed a case against the film's producer, Rakesh Roshan, and music director, Rajesh Roshan, stating that he was not given due credit for Krazzy 4's music. His name was not mentioned on Krazzy 4's audio CDs, and that's the reason he sought legal action and filed a case of copyright infringement.

He is now seeking damages of Rs 2 crores against the Roshans.

The court has instructed the Roshans to delete two songs if they want to release the film on April 11. This means that Hrithik Roshan's [Images] and Shah Rukh Khan's [Images] item numbers will have to be removed from the film.

"To my untrained ear, the music (in two works) appeared to be similar," Justice Karnik, who listened to both Sampath's work for a Sony Ericsson cellphone advertisement, and the two songs composed by Rajesh Roshan for the film, said.

Unfortunately, sources inform that Roshans have already dispatched the film for the overseas release, as well as territories outside Mumbai.

Inspite of repeated calls, the Roshans refused to take phone calls from rediff.com

So SRK and Hritik fans. Bad luck. Even today on MTV they showed Hritik video of the same. It will be actually a big loss for all the viewers as he is really superb in the track. 👏 👏 👏

The dispute is settled out of court and the movie is going to release with all the songs.

Mumbai, April 10: After a day long drama and media frenzy, Rakesh Roshan's Krazzy 4 is all set to release on Friday with all the original song tracks, item numbers and the of course the super hyped title track.

The flick Krazzy 4 had run into deep trouble on Thursday as the Bombay High Court had directed the filmmakers to omit the catchy title track of the film.

Giving its verdict on an appeal filed by Ram Sampath, a 32-year-old ad jingle music composer, the Bombay High Court had ordered the Roshans to remove the film's highest USP i.e. the title track 'Krazzy 4', before it hits cinema theatres.

However, later in the day the two parties reached a settlement and the flick will now release as planned and the case stands dismissed. Roshans, it is reported, will be paying Sampath a sum of Rs 2 crore to settle the matter.

"I won the case, and then we settled the matter "inside the court", Sampath told agencies.

"We went back to the Judge DG Karnik, and got the (earlier) order vacated," he added.

Sampath, had filed an appeal on April 7. In his appeal, Sampath had maintained that the Roshans copied his 60-second music titled 'The Thump'. The young composer had created the title for a mobile phone television advertisement last year and the Roshans had used the same tone in the title track of their upcoming flick 'Krazzy 4' without his consent.

Accordingly, he had sued the producer, Rakesh Roshan, his brother Rajesh Roshan, their film company Film Kraft, Super Cassettes, Sony Erricsson and Saatchi & Saatchi in an infringement of copyright case

But Ram Sampath should not have been content with just Rs 2 crores! He should have insisted that his name be included in CD covers.

What a slap to the face of Roshans! I do hope famous MDs in future will not lift music like this from lesser known MDs and deprive them of credit.

Copiers beware! Gone are the days when MDs could copy and sit back placidly.

Well said. And agree to that part too that Ram Sampath should have asked for the credit too. Hope Roshan's do that to save some face.

I think they will just hush up the matter since they have paid off the protesting MD. I don't think 2 crores is such a big deal to them though it might be for the small-time MD. So shameful of them to pick up a tune from an advert jingle like that and think they could get away.

I wonder why so many Pakistani and Arabic singers have not sued Indian MDs for copying their songs in the recent past. Now that the Indian judicial system has shown that it will stand up against plagiarisation, I hope more genuine cases will be heard.

In an industry where plagiarism seems to be a way of working, I feel truly vindicated. I have been acknowledged as the original composer of the two 'Break free' songs of Krazzy 4 and not Mr Rajesh Roshan, and the dishonesty of the others concerned here has been noted in court. I have been paid damages to the tune of the sum I asked for, and the producers have promised to give me credit in future prints of the film.

I heard the 'Break free' songs around March 18 and was horrified to find that they were taken from 'The Thump,' the jingle I had composed for Sony Ericsson. The jingle had taken over 100 hours of work to compose - all original work requires a lot of time and energy. And I wasn't going to let anyone else walk away with the credit. It was just not on! It was just so dishonest.

First, I tried to check with the company how this had happened. But I was shunted around from receptionist to receptionist, almost as if I had nothing to do with it! They tried to stonewall me, thinking I'd either get scared or run out of steam. The Roshans didn't get back to me either. The Roshans 'supposedly' had an NOC for using the jingle, so why wasn't this NOC produced in court? Obviously it was a verbal agreement, done without my knowledge.

So I went to court alone. And I'm a proud citizen today. Tomorrow if anyone tells me that there's no point in fighting against plagiarism, I can quote my case. The High Court has given a very quick decision. It's a decision which sets a precedent for the music industry and is bound to make plagiarists sit up and think twice.

And I'm not shy about the amount of money. We deliberately kept the figure for damages huge, because this is a first. There will be a second and a third case too. The idea is to make people think ten times before plagiarising other people's work so nonchalantly. Copyright has to be understood and respected. If we can't protect what's ours, there's no point in creating anything.

Everyone in the creative field should get their hands on the 1957 Indian Copyright Act. It makes it very clear that no one has the carpet licence to use your work, or let others use it to their own credit, by paying you a one-time fee. I am not an employee of any company. I was hired as an external collaborator. So there was no question of my work being anyone else's to give away at will.

There has been a huge reaction to the case. Now some people will be proud of me, some will be wary. The money is a deterrent, what I have gained is my right. It was about time that someone got up to protest. I've given permission for the film to release on time because my aim was not to affect business, but to fight for honesty - which I've fought for, and won.

Who's Ram Sampath?
Ram Sampath started out playing keys in a rock band, and was into professional composing by age 17. Over 13 years, he has composed music for over 4,000 ads, 20 TV shows, 4 pop albums like Shaan's Lovology and Tanha Dil, and 3 films. He has done the background score of Ram Madhvani's Let's Talk. He is working on two more films now. He has also collaborated with the international band INXS and with Justin Timberlake.


The story so far
• 'The Thump' is a jingle composed by Ram Sampath for Sony Ericsson in March 2007 and aired in April 2007. Hrithik Roshan endorses Sony Ericsson.

• Sampath filed a complaint against the Roshans using the tune of The Thump in two 'Break free' songs and in the background score in Krazzy 4 without giving him credit.

• On April 10, the High Court gave a judgment ordering the Roshans to pay damages claimed, of Rs 2 crore, to Sampat and to give him credit in all future prints of the film.

• Krazzy 4 releases today, as per schedule.

• Sony Ericsson refuses to comment
