Of course that is true. But that goes into a longer discussion.
The point I was trying to highlight was that Duryodhan and others, and even Bhishma and others, had to all die in the war, because they all committed a crime/supported a crime.
When Arjuna gives up his arms before battle, that is how Krishna convinces him (its a long chapter, but in short), that in establishing justice and dharma, one has to pick up arms. Arjuna did not want to shoot arrows at Bhishma, because he was so close to him, but krishna reminded him that Bhishma is standing with adharm and injustice, that's why he needs to be defeated too, even if Bhishma knows that he is wrong and cannot leave Hastinapur.
