Law is not decided on statistics of cases. Law is decided on equality n justice for all. Even if i am the only 1, i shud still hv the option in Law to seek Justice for myself.

This particular law is flawed. Ridiculous to make it "criminal" offence but it shud be equal. And who said there r no cases. Just go thru the insides of papers each day. U will see so many cases of wife n her boyfriend murdering husbands etc almost every week or husbands commiting suicides. U dont hear about it as Media does not show it on primetime.

And forget Adultery, there r so many laws which are Unequal in India.

Just this week, a Lady teacher was found sexually exploiting a minor boy on the pretext of giving tuitions. She got bail despite being charged under POSCO only bcoz "she is a lady".

because the old men who wrote these laws did not think of women as human beings with agency. You talk about adultery being a crime for men, but you neglect to mention that the plaintiff needs to be another man.

It's insulting to women that the current law treats us as nothing but property so that clearly has to go. I understand the concept of making adultery illegal (for both sexes). It may be destabilizing to family and that may be destabilizing to society. It could be considered a form of theft and fraud. Goodness knows there have been laws trying to regulate less important things. But it isn't very 21st century is it? Now we just divorce at will, the modern way ;)

Because of patriarchy and misogyny. Sometimes archaic attitudes harm men too.
Women are perceived as the weaker sex. She is not believed to have a will of her own. She is the property of her father then the husband. If she strays or makes mistakes, it is because her father or husband was unable to control her. She is not seen as having a mind of her own that is capable of doing good and bad things equally.

A recent horrific event due to this perception was that a teacher who sexually assaulted a child was released on bail because "she was a lady."

The laws have to evolve to include gender parity.

A child molester is a child molester, irrespective of gender.
An adulterer is an adulterer, irrespective of gender. (Although, I think adultery is grounds for divorce and should not be a legal or criminal offense)
The higher earning spouse pays alimony/child support, irrespective of gender.

I don't know why. Some boys were killed by Miranda House girls in their hawas but the college hushed it up.
Like in that movie BA Pass, the boy is abused by all the tharki ladies and there is no chance for justice. It's because those tharki women will make up lies and say the man forced them. Who will believe the man?
Even like that recent case of the tuition teacher abusing the 15 yr old boy and still she's spared just because she's a woman.

Where I come from adultery is not a criminal offence for both and can only be used as grounds for divorce.

What I hated about the movie Rustom was the wife's karnaame very conveniently being swept under the rug by the hubby whilst the guy in question had to pay with his life.Why this injustice?
Both were equally involved in the hanky panky so both should have paid with life.







same thing happened with Maria Susairaj's case too... she was conveniently left by her boyfriend while the guy Neeraj got a grueling death 😡

all these laws are old and needs overhaul...

What a ridiculous law. The words clearly make it sound like a woman is an object. The law should be made gender equal.

It's mainly the case when a married woman is involved while the case where a married man commits adultery with an unmarried woman, there is no case filed. These laws are:

1. Man is always a seducer and the married woman just an innocent and a submissive victim.

2. Wife is no more than a chattel to her husband and a third person had committed the crime of intruding upon his marital possession by establishing a physical relationship with his wife.

3. Only the husband of the treacherous woman (or a person who had care of the married woman) is a distressed party and he is liable to file a complaint against the third party.

4. There is no provision in the law for a woman to file a complaint against her adulterous husband. If a married man commits adultery with an unmarried woman or a widow or with a married woman with the consent of her husband, his wife is not regarded as an aggrieved party and she is not permitted to make any official grievance against her husband.


It's insulting both the parties as where both the parties should be punished, according to these laws women are an object and in case of a married man and unmarried women, the married man has no crime.

In the Philippines, the law differentiates based on the gender of the spouse. A wife can be charged with the crime of Adultery for having sexual intercourse with a man other than her husband, while a husband can only be charged with the related crime of Concubinage, which is more loosely defined (it requires either keeping the mistress in the family home, or cohabiting with her, or having sexual relations under scandalous circumstances).[137] There are currently proposals to decriminalize adultery in the Philippines.[138]
