Why is Adultery not an offence for women?

So I've been following the news about Adultery and how it is only applicable to men and exempted to women. But why? Where is the equality in this when you discriminate the society based on gender. Characters of Salman in Biwi No 1, Masti, Talaash, Henna etc all the men would be going to jail. While the ladies from Rustom, Raaz reboot, KANK etc will be scott free.
Your thoughts?

Sorry for bringing the Bollywood analogy to this discussion but I have to include the examples so that it conforms to the forum.

Because the law makes no sense. That's why it's never followed in actuality.

Why should anyone go to jail for adultery, whether male or female? It's their personal life and they can do what they want. šŸ˜†

In bollywood when a women cheats, there are always reasons, she wasn' satisfied in marriage, they had unhappy marriage, they had problems in house, they were lesbians. So forth so on...

This is what I have read about adultery a few days back during the 377 case was being heard in the court

Section 497 states: "Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery, and shall be punished with imprisonment.

In simple words, adultery is defined as a person having sex with a man's wife without taking prior consent from the husband. The law only applies to men women can neither be charged with adultery, nor can they be the complainant.


Turns out woman can't even file a case under adultery if her husband is cheating on her with another woman. So I guess this law just sees woman as a property of her husband who can file a case if she engages with another man without his consent. Apparently if its with his consent that its completely fine. The woman has absolute no right or say in this matter. So I guess thats why. Its a man versus man thing. For a woman adultery is just the grounds for divorce and nothing else.

Because it is an outdated law and nobody cared to change it. It was made when it was unheard of a woman to get involved in adultery. I hope somebody brings this point forward and change it

That's really effed up.Law should be same for both genders.
Where I come from adultery is not a criminal offence for both and can only be used as grounds for divorce.

What I hated about the movie Rustom was the wife's karnaame very conveniently being swept under the rug by the hubby whilst the guy in question had to pay with his life.Why this injustice?
Both were equally involved in the hanky panky so both should have paid with life.

Yeah I mean...adultery shouldnt be an offence to begin with. but on the opposing side, how many women do you hear about cheating on their husbands and leaving him and her kids for another man? Rarely.
We cant always talk about equality, we all know men do this more than women. perhaps thats the premise for the law (its still wrong but im just saying)
