NEW DELHI: Suggesting radical changes, the Law Commission has proposed reducing the minimum age of marriage for men from 21 to 18 years and declaring unions below the age of 16 as void.

"The age of marriage for both boys and girls should be 18 as there is no scientific reason why this should be different," the Commission headed by A R Lakshmanan said in its report.

The suggestion by the Commission for declaring marriages below the age of 16 as void is something which has not been recommended in the statutes.

It has also pressed for compulsory registration of marriages and recommended that men, just like women, should be allowed to wed at 18 and children below that age barred.

In its 44-page report presented today to the Law and Justice minister H R Bhradwaj, the Commission has also proposed that the age for sexual consent should be raised from 15 years to 16 years for all girls, regardless of marriage.

If accepted by the government, consensual sex with girls under 16 years of age could invite punishment meant for rape.

A man's sex with their minor "wives," aged below 16 years, could also become punishable. Under the existing laws, having sex with a minor "wife" above 15 years is not rape.

Besides recommending compulsory registration of marriage, the Commission has proposed that marriages involving children between the age of 16 and 18 be made voidable (which can be annuled with mutual agreement between both the parties on attaining adulthood).

While studying the Prohibition of Child Marriage Act, 2006 (PCMA), the Commission found that the present law did not make a child marriage invalid even if it was below the age of 15 years. But under the criminal law.

Istead of raising the age limit (I think the age should be raised to 23 for both men and women), they are thinking of decreasing it? 😕 Bad move!

does that mean a girl can deliver a baby at 16.. man she will live to be a great great great grand mother.. are we going back to the 14th century or wht? 😊

not a great idea imo. at that age, guys shld be focusing on better things than on buying choolas and making trips to the sabzi mandi. 😆

😆😆😆 😆and they need to be apney pairon per khadey huye for them to afford the chulha and sabzi😆 don't see how that's doable at 18 unless one is born rich and living off his parents'.😆

seriously, i feel they need to distinguish between the age for consensual sex and the age for getting married. a gal of 16 married to a guy 18 doesn't make much sense to me as emotional maturity is not there. then, there r issues related to the gal becoming a mom at 17 in this case. if i'm not mistaken, her body is not ready for nurturing and giving birth to a child before 18.

Yah, i came across this article , good did not post new topic, phir se topic close hojatha, 😳

anyway getting back to topic, what is going on...??

I used to feel, 21 is still kachi umar for men , now 18, wow... 👏

then why don't we go back to old custom of child marriage, sab ka bhala hogaa. huh!

I don't think this issue will have its impact anywhere.....I wonder if normal girls are getting married immediately the day the turn 18😛. Ideally that girl will be in her university / college at her 18th year(provided she passes all the previous years of study😆).....same with the male creature..he is not a superman to complete the education by 18....or atleast does'nt get settled in his career....and who will be interested to marry not so educated fellows😃

Govt of India....better concentrate on formal education rather than....😃

There are so many instances of underage men and women getting married defying the current laws. I think the aforementioned step is being recommended so that at least these underage marriages will have a legal status, as people might now register them.

All these years of having 18 and 21 as the legal age for getting married hasn't ended the custom of child and or underage marriages. People even get fake birth certificates to avoid legal hassles (if anyone actually bothers to stop them - activists have been known to being beaten up by the police when they've tried to stop child marriage ). No law will change the mentality of those who believe in these medieval customs. At least, this might give some legal recourse to those involved in these marriages.

hmmm...u raised a good point about those marriages that has already taken place. well, in that case the govt shd do what u.s. does. have this amnesty thingy where they recognize all such marriages that had already taken place and put strict rules with a higher age going fwd😃

does the govt have a definition of what constitutes sex in the first place? if u ask clinton, u'd know what he'd say.😉

anyway, cant believe that folks wld actually want to get married that early. someone shld tell them that duniya bahut rangeen hai.😉

I am so with you , that we will have less followers of the law

but that is limited to a defined society. like where girls and boys studying, building career, etc at 18

but moving on to rural homes, they wait to shoo off their girls, and finding 18 year old gaon ka chora is what they will happily do to spoil girls life.

and my fear is , if guys allowed to marry at 18 , they will marry atleast three girls before reaching 50 , and maula janey kya hoga agey 😕
