This courtroom drama made me realise

This courtroom drama made me realise something that I always missed in my life, missed to realise, to understand.
In India, people at very young age get embraced by the fact that a whole lot of rapes occur in India and there in most cases, culprits are punished really late or not punished at all.
I always thought to myself, isme itna sochne ka kya hai, rape hai, crime hai, saza sunao aur khatam karo

But no things are not done like that in India. Not only the culprit but the victim is to be blamed in India.
The defence of course has to defend the accused one, so they can ask whatever they want.
As someone here in the forum wrote "all questions are valid pertaining to victims past as they will prove how unreliable she is and show she has faked a rape"
Here in Maya's case , Saanjh is telling how Maaya is possessive and manipulative.
But one thing that no one can deny is that everyone is flawed, so any X girl would have some flaw, and that would be the criteria of her faking an attempt to rape.

For example, let Saanjh be the girl who was raped or molested by someone.
Now in the courtroom, defence lawyer presents the court 3 evidences and a few eyewitness.
1) Saanjh and Arjun almost kissing in a bar photo
2) Saanjh and Arjun Holi dance video
3) Eyewitness and video of Saanjh on ArYa wedding where she sings romantically for Arjun
And on these basis he proves Saanjh to be characterless and this would prove that she has faked a rape.
However this is no proof for the case just the degradation of Saanjh's character out in the open.

And don't get me wrong, I am not talking about Saanjh or Maaya in particular, but talking about all the sexual harassment or molestation cases or rape cases in which both men and women are involved.

The problem with the lawyer is, he is not questioning the victim, he is assertively putting down the victim.
And whosoever says or accepts this kind of behaviour is wrong.

Even if the girl is psycho, thief, murderer, terrorist or anything, Indian law clearly reprimands any unequal treatment with the statement, all are equal before the law.

This Maaya Ayaan Saanjh case made me realised , how a rape case is different on TV and completely different in real life.
Everyone is flawed- Maaya Ayaan or any person amongst us
Is being flawed, or wrong what makes us decide that the person is culprit or victim.

This is not about the show but our society. Making mistakes or being wrong or even being a criminal would not be sufficient to prove that the victim is faking, it only proves how we do not support the idea of equality before law.

Incorrect. Here are the important discoveries that Sanjh has made so far:

1) Maya abducted Arjun and Ayan went to rescue him. When Ayan tried to rescue his brother, Maya blocked his way and refused to give him the keys to the room where his brother was locked in. Ayan did not go there with any sexual intent.

2) Maya drugged and tied up Arjun. This is important because one can deduce that she did it so Arjun can't interfere in whatever Ayan does.

3) Arjun lied about what happened that day, based on his conflicting statements that he heard what Ayan said but was so inebriated that he couldn't help Maya. This reduces his credibility as a witness.

4) Maya lied about several things that happened that day, like what she did in the plane, ambulance or in their house. This reduces her credibility.

5) Maya has voluntarily injured herself in the past.

None of these have anything to do with Maya's character. If Sanjh was the victim, and you were able to produce some videos showing her in a bad light, unless it was directly relevant to the case, it would have no bearing.

Also, those instances you mentioned do not show that Sanjh is characterless in the slightest. Everything that happened there was consensual.

See that's what I meant, firstly I was talking about in general and not the show, secondly you yourself admitted that it is okay to blame someone based on everything other than the attempt to rape scenario itself. She has cctv footage which would help her out in key theory but she wants to talk about Maya's pregnancy .
But I am not talking about that. What I am saying is that this drama made me realise what amount of trauma a rape victim goes through in court.
It was actually not relevant to Maaya, ot was a realisation I had after watching this whole drama.

I just don't understand these posts.
Saanjh kissing or almost kissing arjun, Saanjh singing at marriage etc etc according to you can prove a girl characterless but not a liar. But whatever saanjh put forward can hell lot prove that maya is a manipulator and a liar by habit. And she has ulterior motives to frame Ayaan. End of it. The defence lawyer was doing her job though according to me she needed more proofs to her point. But what was the prosecution doing? Supposedly nothing.
Saanjh's case was to prove ayaan innocent by proving what a framer maya has always been and why has she been doing it. That's all. How does this have anything to do with characterlessness?

I understand, I was replying to the part where you said that if Sanjh was the victim, then those pieces of evidence could prove that she made a fake allegation.

No, it isn't okay to blame someone based on things other than the actual scenario. What I mentioned happened exactly where the supposed rape attempt took place.

Fair enough, but surely you agree that whatever trauma an actual rape victim has to experience in court is necessary to make sure that no innocent ever gets convicted?
