- By applying for the programme, all applicants agree to abide by the processes, rules, regulations, terms and conditions (the "Rules") of "Lead India" which expression shall include any interview, auditioning process, competition and event relating thereto (the "Programme") as devised from time to time by Bennett Coleman and Co. Ltd. (BCCL) and shall accept the decision of BCCL as final and hereby acknowledge that the interests of the Programme shall override those of any applicant.
- No entry fee is payable.
- Applicants have not and will not enter into any commercial or other sponsorship agreement (such as a management contract and/or merchandising contract etc) or arrangement with any person, firm or company in respect of his/her participation in the Programme.
- Applicants cannot have any criminal record nor be an undischarged insolvent or of an unsound mind.
- For the purposes of the participation in the Programme, applicants may wear any apparel of their own choosing provided always BCCL fully reserves all rights to disallow any apparel which BCCL deems in its absolute sole discretion to be obscene vulgar lewd defamatory libellous infringing or prominently bears any commercial/company logos, marks, brands, or the name/likeness/image of a celebrity.
- The Applicant hereby agree that he/she has truthfully and accurately completed the application form and that the answers and information supplied here is in no way misleading. Applicants furthermore acknowledge that BCCL reserves the right exercisable at any time at its sole discretion to disqualify the applicants from the programme should the applicants at any stage perform or behave in an inappropriate or obscene manner, supply untruthful, inaccurate or misleading personal details and information, break the Rules or otherwise be in breach of the terms contained herein.
- Only applicants between the ages 25 to 45 years of age as on 1 Aug 2007 are eligible. Applicants will be required to produce copies of birth certificate, passport, voter ID card (issued by Election Commission) or such other applicable and acceptable documentation, as we may reasonably request, confirming your identity and age.
- Without limiting the foregoing in any way, the applicant agrees that the BCCL shall be entitled to:
(a) alter, adapt or make additions to or deletions from the Programme (and the applicant's appearance thereon) at its discretion;
(b) make and exploit and to authorise the making and exploitation of any recording or fixation of your appearance separately from or in conjunction with the Programme throughout the Universe in perpetuity in all media whether now known or hereafter invented;
(c) include the applicant's name, likeness, voice, biographical details, photographs of applicant and recordings of interviews with applicant separately from or in conjunction with the Programme in all media and formats throughout the Universe including but not by way of limitation in advertising, publicity and exploitation material.
- The applicant shall not publicise or discuss with any third party without prior written consent from BCCL, any information relating to the Programme, applicant's appearance, any of the production team or any participants in the programme nor any other information which may come to the applicant's attention relating to the broadcaster or the BCCL or otherwise connected to the Programme save for such information which is already public knowledge. The applicant shall further agree to keep the competition rules and the contents of any documents in relation to the Programme strictly confidential.
- The applicant hereby expressly acknowledge that no fees, royalties, residuals or other consideration will be payable to the applicant in respect of any publishing, broadcast, subsequent rebroadcast or retransmission or any other use by BCCL and/or or any assignees or licensees of the Programme or any part thereof in any manner or media/medium now known or hereafter invented.
- By applying for the Lead India Programme, the applicant agrees to be bound by these rules and the decisions of BCCL, the voting audience, and the panel of Judges, which shall be final and binding.
- With full title guarantee the applicant hereby irrevocably assigns to BCCL (including present assignment of future copyright) the entire copyright and all other rights of whatsoever nature in and to the applicant's contribution to the Programme such that the BCCL shall be entitled to use and exploit and license others to use and exploit such contribution by all means and in all media and formats whether now known or hereafter invented throughout the Universe for the full period of copyright including any extensions and renewals thereto and thereafter insofar as is possible in perpetuity and the applicant furthermore irrevocably grants all consents and waivers as required by statute to enable BCCL to make fullest use of the Programme without restriction. Furthermore the applicant hereby waives irrevocably in respect of the applicant's contribution any and all "moral rights" which the applicant may have now or in the future including but without limitation any of your rights under the Copyright Act [1957] or any similar laws of any jurisdiction and acknowledge BCCL's right to use the applicant name, likeness, voice, biographical details, photographs and recordings in advertising and publicity material and content in any media including but not limited to newspapers, radio, television and internet.
- The applicant's presence in various activities around the programme, and the presence of his/her friends, family members and anyone else accompanying the applicant, constitutes his/her and their consent and agreement to the recording and use of the applicant's and their performance, appearance, name, written material, interviews, likeness and any musical or sound effects produced by the applicant and/or his/her family members, friends for use in connection with any television program, motion picture or the Internet for all purposes (including advertising, marketing, promotion, merchandising and the exploitation of any and all ancillary and subsidiary rights), as the same may be edited, in all media, throughout the universe, in perpetuity for no compensation, unless otherwise required by law. The applicant further represent to BCCL, their affiliated, related and/or associated corporations that the applicant/his/her friends/family members agree that BCCL shall not be liable to the applicant or his/her legal representative or them for any loss or damage or injury to you, them, the applicant's property and their property caused by or suffered during or in connection with your taking part in the Programme, including without limitation, as a result of personal injury, invasion of privacy, libel, defamation or infringement of copyright, unless caused by the gross negligence of BCCL and recoverable on that ground following judgement of a competent court of final judgement.
- The applicant is aware that the dates and locations of the Programme are subject to change. The applicant agrees that the BCCL and/or the production personnel for the Programme, participating television stations, advertising agencies or any person or entity connected with the production, administration or judging of the audition or the program, or any of their respective parent companies, affiliates, subsidiaries, agents or representatives are not responsible for and shall not be liable for: (i) any failure or transpiration, bad directions, or inability for any reason to appear at a venue for the programme or appear before the judging panels; (ii) any costs, expenses, injuries, losses or damages of any kind caused by travelling to or from the audition venues, being present at the venues for the programme or being selected to or disqualified from continuing in the auditioning process and/or the show; or (iii) any printing, typographical or technological errors in any materials associated with the Programme.
- The applicant acknowledges that BCCL in no way warrants, represents, guarantee or promise any rewards or prizes other than those specifically stated to the Programme.
- The applicant further represents that he/she is not an employee of, or live with an employee of, or are a parent, sibling or child of an employee of, the following : "BCCL, its vendors, the judges; the host(s); production team; any prize providers and any person or entity connected with the production, administration or judging of the auditions or the Programme, including any potential affiliated auditions or competitions held by radio stations or television channels; and the parent companies, affiliates, subsidiaries, agents or representatives of any of the above entities".
- The applicant agrees that BCCL may assign the applicant's services and all other rights in the applicant's contribution to and participation in the Programme to any of its holding, subsidiary, affiliated, related and/or associated corporations / companies or successors in title and to any other third party at any time.
- The applicants cannot change the choice of city after registration.
- All Multiple applications shall be rejected.
- BCCL shall not be responsible for any postal delays.
- BCCL reserves the right to modify, cancel, discontinue or terminate the Lead India Programme at any time or to accept or reject any or all registrations at their absolute discretion without giving any prior notice and without assigning any reason whatsoever.
- The applicant hereby acknowledge the BCCL's right to use the applicant's name, likeness, written material, interviews, voice, biographical details, photographs and recordings in advertising, publicity material and content on television, radio, newspaper, internet etc. BCCL shall have all rights to release advertising and editorial and undertake publicity including, but not limited to media, in newwspapers, Radio, Television, Internet, Outdoor Hoardings etc for The Lead India Programme. BCCL shall be free to carry the details, pictures, profiles, interviews any or other information gathered by BCCL about all or any of the participants during the course of the Lead India Programme. The frequency, duration, content of all advertising, editorial and other publicity shall be at the sole discretion of BCCL.
- The Times of India shall bear the Cost of Travel, Cost of Living in Boston-USA and the tution fees for the Leadership Development Programme at the John. F. Kennedy School of Government at Harvard for the Lead India Final Winner. The Lead India Final Winner shall have to confirm to any eligibility conditions/ US visa regulations and any other statutory requirements as may be applicable. In case the Lead India Final Winner is unable to meet any of the statutory requirements as set by the University of Harvard or US Government or if he/she is unable to undertake the course as per the schedule decided by BCCL, his/her candidature/reward for this Leadership Develop Programme shall be forfeited. This Leadership Development Programme cannot be exchanged for its value in cash.
- BCCL shall make available a corpus of Rs 50 Lacs to fund a public service project recommended by the Lead India Final Winner. This choice of this project shall be subject to approval by BCCL before any aspect of the same is executed or any funds are released for the same. BCCL shall fund this project through Times Foundation. Times Foundation shall release the funds at appropriate intervals against submission of bills for actual expenses incurred for executing the project. The decision of Times Foundation in approving or declining any payment shall be final and binding on the Lead India Final Winner. In case the project progress does not meet the deadlines and benchmarks decided by BCCL, the funding for the same shall be irrevocably terminated.
- The First Runners up and the Second runners up of the Lead India Programme shall not be liable for any prize or awards.
- In the matter of interpretation of any rules and conditions of the Lead India Programme, the decision of BCCL shall be final and binding on all applicants.
- In the event of any dispute, the same shall be referred to arbitration. The arbitrator shall be appointed by BCCL, whose decision shall be final and binding on both parties.
- The courts at Delhi shall have exclusive jurisdiction.
