A forced marriage is a violation of human rights, as well as a form of Gender Based Violence as it usually involves mental abuse, emotional blackmail and coercion from either the family or society. Many cases also involve physical violence, abduction, detention, threat of murder, or murder.
If a woman has been forced into a marriage, is such a marriage void or voidable? What if a fraud has been played on her?

Such marriages are voidable. If the consent of the complaining party has been obtained by force or by fraud relating to the nature of the ceremony performed or to any significant fact or circumstance concerning the opposing party, the marriage can be voided. However, a petition for annulment in such a case must be presented within one year after the force ceased to operate or the fraud has been discovered.

What forced marriage ?
The girl who herself sat in Mandap even after objection by her own mother's
How's called as forced ?

There's no need of divorce in this show when a girl herself declared as widow of BF

Forced marriage rules does not apply in this case This marriage cannot be nullified under forced marriage rules This has to go through divorce

I heard and also seen in savadhan India that within 6 months of marriage, marriage can be nullified. So only 3 months are passed here, so I think marriage can be nullified

u can't nullify a mrg until its a fraud mrg like sum1 forcefully made u sit in the mandap.and here viv is not forced 2 sit in the mandap.she made deal & on her will get mrd.
and u can't even take divorce mutual consent wid in 6 months of a mrg unless ur spouse is abusive,mentally/physically disabled or obsessive etc.

and u've 2 wait for 6 months as court asks u 2 consider for 6 months & try 2 work out the mrg.just bcoz u luv sum1else & is forced emotionally 2 marry sum1else is not basis of divorce in India.
ask any lawyer.
they've 2 stay under one roof for 6 months.and then they still don't want 2 continue then they can take divorce.
but as such mrg can't b nullified until its child mrg but that also u can't nullify after 2yrs of reaching puberty .

Google out Hindu marriage law on force marriage then u will get ur answers and may be at least then u will accept it was a forced marriage. 😉

It is very much applicable in Vividha's case just google it out guys. I don't know why u guys have problem in accepting it's a forced marriage as most of TV hit couple's had forced marriage.
