I agree, they should not do away with the question. It is her question that forces the sabha to introspect what they know of dharma and acknowledge how ambiguous it could be. It is her question that differentiates between the written word of law and universal values of justice and highlights how fallible our idea of dharma can be and how it needs to be adapted to the prevailing times and the situation. They have already established that Draupadi was an intelligent, fearless and dignified woman when she intervened in the dicegame to stop it. This question would bring out another of her qualities-presence of mind in the face of personal adversity as bheegi pointed out.
