Case of speedy justice

Hello Readers. We are aware of Shakti mills gang rape case in which how a photo journalist and her male friend were befooled by a group of four men, luring them to click photos from the nearby place. They took them to a building of an abandoned Shakti mills compound, tied the hands of her friend and gangraped the girl twice. All this happened in a broad day light and that too in the vicinity of a police station. Encouraged by the photo journalist complaint another girl a telephone operator by profession also lodged the complaint of being gangraped at the same location. The culprits, though tried to abscond but later on were caught by the police and jailed.
The trial of the convicts continued for 8 months and finally the Mumbai session's court pronounced the judgement as the Judge Shalini S phansalkar- Joshi sentencing the four convicts to life term . The judgement is noteworthy as it has sentenced maximum punishment as per amended law strengthening the penal provisions. the provisions under section 376 D is related to gang rape and accords for maximum punishment which is impriosnment for remaining period of life. The afore mentioned punishment is announced for the gangrape of telephone operator.
The judgement in respect of photo journalist is withheld as the prosecutor in this case has demanded for capital punishment. The issue is whether capital punishment is desirable when convicts have been sentenced for remainder of life.
Friends after the dec 2012 incident there was discontent among the masses regarding the safety of woman and the general outcry it seemed will have no impact on the judiciary to emphasise on speedy pronouncement of punishment. But the judgements in Nirbhaya case and the pronouncement albeit in Shakti mill case have reimposed our faith in the Indian Judicial system. The swift action will go a long way not only in curbing the malicious crime but will also allow the victim to get dispensed with justice at the earliest. Well we sincerely hope our nation is free from such inhuman incidents and wish the stringent laws prove to be a milestone in this reagard.

Thanks for the pm.One way justice might have bee done with life imprisonment but they should have been hanged for what they did? They have no right to live. The victims are traumatized for the rest of there lives and there life will never be the same.
Thanks Hema for updating me on this.

Minki😊, thanks for sharing and posting the article. I really appreciate you for it. For protection of women from rape case strong steps, actions, special care etc are very essential in our Society. The tasks of investigating, prosecuting and judging crimes of rape need special attention. Our government must establish a legal framework that meets international standards to protect women's rights.

Thanks Nisha , Nandita , Tulasi , Minu for sharing your views . The speedy judgement will set the precedent for other cases and hope it creates the fear of punishment among the anti social elements who commit such henious crimes and for whom women is considered merely an object to satisfy their beastly instinct.

This speedy trial and judgement will set an good example for other courts, and restore some faith of people in the justice system. Also it needs to be followed in lesser known cases, which dont get media attention..and we dont know. Some cases decade old are still going on, need to be relooked and sorted out.In such heinous crimes quick justice is needed to show zero tolerance to such crimes and get the barbarians pay for their deeds.

Thanks for sharing your views Techtonic. Really hope the judgement both in Nirbhaya and telephone operator's case creates a sense of fear among the perpetrators of such crimes, but you see the Nithari case where the servant got the punishment and the master was set free although he was equally responsible for the gruesome killing of the girls.

Thanks for sharing this info Hemangi.
For me, it's a quest to find an answer to these problems. How can we live in such a society where there is little safety for us and our sisters, daughters. I dream of a day when there would be no such case would be reported ever. Where women may wander in street freely even at 12 at night. I may seem like a fool, however I would add my little effort in this area. May my pen could bring some difference some day.

Thanks for sharing your views Debbie. Most of us share your dream. I am sure your pen will make the difference but for this our society needs cent percent literacy, especially the lower strata, the labour class who are largely involved in committing such crimes.

Nithari killings' is another blot on the civilized society !

Reports of some children missing from Nithari turned into the most gruesome serial killings in India.( Nithari massacre: The real story of India's 'house of horrors' -Daily Bhaskar,july16,2013)

Child after child went missing. They were poor and even eking out a minimal living was hard enough for them and getting past a police stonewall was something superhuman.

Some locals saw the remains of the children in the drain behind a house and suspected involvement of Surender Koli, the domestic help and Moninder Singh Pandher, owner of the house, who offered the police everything the parents of the missing children never could. The owner had wealth, powerful connections and free gifts to hand out. Some policemen, in turn, had powerful Yadav' connections too !

Later the investigations revealed that ... organ trade , po*n video recordings , child abuse , murder, and cannibalism...everything happened there ...except justice , more than 17 children were raped , cruelly murdered and some were eaten by Koli...

After reading this I lost interest in life for many days ... I was scared to even think about these gruesome murders !

Still... justice is yet to be done to those tender lives whose sufferings are incomprehensible !
