The three convicts in this Shakti Mills photo journalist gang rape case
have received no relief from the HC.
It was hearing a petition by the accused,which challenged the adding of a charge that attracts death penalty .
But here the irony of justice is ...a window has been left open for the accused , who can raise the issue before the trail court of whether the charges were
properly added ?!!😡
Now the newly introduced 376 E of the Indian Penal Code , a repeat offender in a rape case can be sentenced to serve prison term for his whole life or given the death sentence .
But again another escape route left for the convicts here ...the accused
will still be entitled to raise the issue of the applicability of section376 E before the trail court !
Justices Naresh Patil and Abhay Thipsay said ,'' we leave the issues open'' !
So the accused can raise the issue, and question the constitutional validity of the section !
The need of the hour is ...yes Hema ...as you rightly said speedy pronouncement of punishment , and allow the victim to get dispensed with justice at the earliest ! Let us see .

Child after child went missing. They were poor and even eking out a minimal living was hard enough for them and getting past a police stonewall was something superhuman.

Some locals saw the remains of the children in the drain behind a house and suspected involvement of Surender Koli, the domestic help and Moninder Singh Pandher, owner of the house, who offered the police everything the parents of the missing children never could. The owner had wealth, powerful connections and free gifts to hand out. Some policemen, in turn, had powerful Yadav' connections too !

Later the investigations revealed that ... organ trade , po*n video recordings , child abuse , murder, and cannibalism...everything happened there ...except justice , more than 17 children were raped , cruelly murdered and some were eaten by Koli...

After reading this I lost interest in life for many days ... I was scared to even think about these gruesome murders !

Still... justice is yet to be done to those tender lives whose sufferings are incomprehensible !

Seetha in the Nithari murder case the girls were firstly raped by Mohinder Pandher and later on by his servant. But Mohinder was released and Koli was sentenced capital punishment. It boils our blood that when both were responsible how come the other accused was not convicted. Casteism and communalism are like termites which is biting our nation since long. Pest control systems are able to put a check on the rapid growth of termites but the two enemies of democracy are flourishing because of the vote bank politics.

Thanks for the information Seetha. But if sec376E suggests for any sort of relief to the accused by any chance then again it will prove to be a blot on our judicial system.
