Is this marriage valid ?

Perna & Anurag didn't get married officially but, they didn't divorce either. And when perna was pregnant that time she married Bajaj . Is it allowed in Hindu religion to get married while a woman is pregnant ?

Of course this marraige isn't valid. A marraige which is valid legally as well as done with all reeti-riwaz in front of society, of course doesn't hold valid.

In ITVs, marraiges conducted between two people who themselves didn't know they are married at the time of marraige, is what is considered valid and legal. Example, AnuPre's dhaaga marraige !

So going by ITV logic, Prerna-Bajaj marraige is invalid 😊

😕 Am i the only one who feels that both of this marriage is invalid.As 1st one was done secetly & 2nd one was done when perna was pregnant cj as far as i know pregnant women is not allowed to get married.

Assuming yours is not another post to troll and an honest question - then the answer is - yes, you can absolutely marry an woman when she is pregnant with your or another man's child and the marriage would be absolutely legal and valid .

And Anu and Pre only slept with each other, they were never married...so where's the question about divorce? Theirs was the most common scenario - guy coerces the girl to sleep with him and then ditches her to marry another when she is pregnant . Sad . 😒

Anurag and Prerna never got married. Period. There's no question of getting any divorce.

Pregnant women are allowed to marry in Hindu religion. From where are you bringing rules that does not exist in the 1st place?? Convenient indeed!

Many times live in couples get married only when the lady gets knocked up. Widows get married off , some times with in the family itself if they're pregnant.

In Silsila, Amitabh married Jaya's character only because she was pregnant and her husband was dead. In Balika badhu, Sugna was married off to Shyam when she was pregnant with her first husband's child.

1st is invalid, 2nd is valid. Not a PreRish fan but the marriage is valid. There is no such rule of not marrying when the lady is pregnant.

There is still a chance that PreRish marraige can turn invalid. It depends upon CVS. If they show Bajaj hasn't taken divorce from his first wife , Miss Meneka Bose, then PreRish marraige won't stay valid.

Well, I need to be seriously studying Company Law but I decided to read the Hindu Marriage Act instead, my general frustration towards life is at its peak. 😆

Okay, so I am not quoting the bare act, but it bottles down to this, if Bajaj goes to court saying at the time of marriage, he did not know P was pregnant with someone else's kid (person other than petitioner), then the marriage can be considered null or void. Only if HE petitions. Which means it is voidable. Not void. Which also means, if he does not make a petition, the marriage is valid. [Section 12(1)(d)]

The next one is interesting actually.

As per Section 12(1)(c), if Prerna petitions that at the time of the marriage, she did not know about RB's kid (a material fact about him and the circumstance) OR

her consent was obtained by force or fraud (coercion)

then the marriage can be annulled, which means it is voidABLE. Not Void.

HOWEVER, Prerna cannot do either of those NOW, because, reading the above with 12(2)(a)(ii), she chose to live with him despite being aware of the force and after discovering the fraud (material fact about his daughter).

So, yeah, the marriage is pretty much valid. So sorry if I bored you guys with provisions, I am too bored for life, and was attempting to read law. 😆 Btw, I have ignored that dhaaga marriage or whatever they showed coz I never watched it and I can't go back and watch now, so idk if something else applies.
