After reading this chapter few times, I agree somewhat that the trial room conversation was not needed but if you think from past few chapters perspective, thats one of the many things that bothered him and hurt him most. He could have conveniently shared intimate moments with her on that couch but he wasnt sure yet if she is going to slam it as mistake again in future. He needed that little confirmation or her approval to proceed further, to whatever happened next.

Also, its too early for him to discuss or demand her to share her pain, since she doesnt know that he knows most of her past.
