So if it's unintentional then it doesn't count? Him being drugged affected his senses and since he was on duty that could have been a serious problem. He could have administered the wrong drugs which could have caused some serious problems.
I'm from Canada and there are serious issues over here with the doctors being overworked which is causing serious issues with their work. And that's just being overworked not even drugged so don't tell me that's not a serious issue. I have family member who has been handicapped forever b/c of these faults.
Also how could a sleeping drug cause death? I'm not a medical person but I seriously doubt this.
Final point: theft is still a crime and it is punishable no matter what the intentions.

Anyhow all this does not need to be discussed here b/c this is a fictional show not reality.
