New Delhi: A Patna sessions court on Wednesday sentenced to death former MP Anand Mohan for inciting a mob to kill former District Magistrate of Gopalganj G Krishnaiah in December 1994.

Three other accused in the case were also given death. Mohan's wife Lovely Anand, also a former MP, and JD(U) MLAs Munna Shukla and Akhlaq Ahmad were handed out life terms.

On October 1, the court had convicted Mohan, Lovely, Ahmed, Shekhar and Arun Kumar Sinha under Section 109 (abetment) of IPC.

On December 5, 1994, Krishnaiah, a 1985-batch officer, then posted as DM, Gopalganj, was on his way back to his headquarters after a meeting at Hajipur near Patna, when he was attacked by a mob.

The assault on Krishnaiah was in retaliation to the gunning down of Chhotan Shukla, an underworld don who also worked for the now-defunct Bihar's People's Party.

Chhotan was a close aide of Mohan and the brother of Vijay Shukla, alias Munna Shukla. The incident took place when Chhotan's body was being taken for cremation led by Anand and others.

Mohan, a former MP from Sheohar, who was then the BPP chief and Lovely, former MP from Vaishali, were present at the funeral procession besides Munna Shukla, the younger brother of Chhotan, former MLA from Bikramganj Akhlaq Ahmed, Shashi Shekhar and Arun Kumar Sinha.

They were accused of having incited the mob to kill Krishnaiah. The judge, however, acquitted 29 of the 36 accused in the case, giving them benefit of doubt.

Hopefully the judgement will be upheld by the High Court and then Supreme Court. These people deserve it.

Is indeed a Landmark judgement. How far it is justified or another politically influenced judgement? Not Sure! havn't followed this, alarming to know this case was going on from '94.

Ex-MP, 2 others get death for district magistrate's murder

A Patna court on Wednesday sentenced former member of Parliament Anand Mohan and two others to death for the murder of Gopalganj District Magistrate G Krishnaiah in 1994.

In a landmark verdict that is bound to have political ramifications, Additional Sessions Judge Ram Krishna Rai also awarded capital punishment to two others -- former MLA and Rashtriya Janata Dal leader Akhlaq Ahmed and Arun Kumar -- in connection with the brutal killing of G Krishnaiah on December 5, 1994.

Anand's wife Lovely, a former MP from Vaishali, was awarded the life sentence. The court also gave life sentences to Vijay Kumar Shukla alias Munna Shukla, a sitting JD-U MLA from Lalganj, Shashi Shekhar and Harendra Kumar.

The court had earlier found Mohan, who was a leader of the Bihar People's Party at the time of the incident, and his wife guilty of inciting a mob to lynch Krishnaiah.

The district magistrate was killed near Khabra, on the outskirts of Muzaffarpur, by a mob that was enraged over the death of Chotan Shukla, an underworld don with political ambitions. Shukla and three others were gunned down when they were returning from an election campaign for the 1995 assembly polls.

The district magistrate was lynched by a mob accompanying the funeral procession of Shukla on December 5, 1994. The officer was pulled out of a car, beaten mercilessly and then shot dead. The court also slapped a fine of Rs 25,000 on the seven convicted accused. Earlier, 29 of the 36 arrested accused were acquitted on benefit of doubt.

Soon after the sentences were delivered, the seven convicts complained about the shabby treatment meted out to them at the Beur Central Jail. Mohan said that he, Akhlaq Ahmed and Arun Kumar were locked up in a cell without a fan. He added that his wife Lovely Anand was lodged in a ward along with mentally retarded women.

"As long as we are alive, the court should ensure that we exist like humans", Mohan told the judge, who responded that he will write to the jail superintendent and Patna district magistrate about the matter.

Speaking to mediapersons later, Mohan pointed out that 15 inspectors and two sub-divisional officers accompanying the funeral procession of Chotan Shukla could not save the life of the district magistrate. "What could I have done," he said.

Munna Shukla said he was with the body of his slain brother in front of the funeral procession while the district magistrate was lynched by the mob in the rear. "I simply do not know who killed Krishnaiah," he said

Check out the last two para... isn't mob responsible here... is instigation resposible for capital punishment? They didn't physically killed him. Another point would like to bring in contract killing... is the shooter responsible or the person who hired him?

I am sure the court must have found enough evidence to give them death penalty. The the sentenced people are known gundas/criminals (with several serious cases against them) in Bihar..maybe this'll prove turning point in Bihar's fortunes. I saw Mrs.Krishnaih's interview after the judgement..hope we don't let her down.

Hmm and I thought to be Gunda was a qualification to become a succesful leader 😕 😆

Hopefully justice and done and it brings some senses to these power hungry people.

I hope that people who vehemently contested Salmaan Khan's ruling on the pretext that the Indian Judicial System is partial, think otherwise.
