As much as we feel that Indian society is open, and that we are accepting women as equals. But, it is a fact, that however open we may be, feeding of male ego is important. And of course, what better than asserting one over the woman, and that to sexually.
Its not surprising per se, that a room full of men would decide on such a thing. Really. Not at all stunned.

I dislike and somewhat am offended by 'most husbands are jerks' statement a bit too.No hard feelings, but there are always n number of people taking advantage of some loopholes all the time.
We first need to make sure we have some method which can deter a rape from consensual sex between spouses..else there will be a lot of women taking unfair advantage of this especially when the divorce laws too are biased towards women.

Well yes. You made a very valid and essential point. There are times, when woman herself misuses this power given to her ( if and when ) at times when the man does not deserve it.

Keeping everything else aside, how could one conclusively prove marital rape?

This is absolutely terrible.
India has not stepped ahead of few old-age practices. Girls even today marry because their parents ask them to (and girls do that for their izzat and stuff like that) when they actually don't want to do that. In cases like this, touching a girl's body can be against her will.
Why does this not constitute as rape? Just because we freaking married the guy? We married him. Marriage is not permission for sex. Marriage can never give the guy right to exploit us.
In India, sex below the age of 18 (girl) can be taken in as a case of rape as per the law even if the both consented to it if the parents of the girl say otherwise, yet here this will not be considered as rape because I married the guy.
Ridiculous! 👎🏼

Yep! Marriage does not, by default, erase the need for consent. I guess justification for marital rape stems from the socially perpetuated belief that sex outside of marriage is "wrong" and sex within marriage is "right".

Sexual assault should be a crime, regardless of the relationship between the rapist and the victim. They could be complete strangers, or acquaintances, or spouses. It doesn't matter.

To say that marriage justifies rape is one of the most preposterous things I have ever heard.

It may work if they make forced marriages illegal. Any marriage conducted under pressure and against the will of the boy or girl should be considered illegal and stand cancelled.👎🏼

On the contrary there are some people including a Chief Justice of Chennai who thinks it is OK for the rapist and the victim to negotiate marriage to escape punishment😲 Can anything be more deplorable
