I dislike and somewhat am offended by 'most husbands are jerks' statement a bit too.No hard feelings, but there are always n number of people taking advantage of some loopholes all the time.
We first need to make sure we have some method which can deter a rape from consensual sex between spouses..else there will be a lot of women taking unfair advantage of this especially when the divorce laws too are biased towards women.

Sexual assault should be a crime, regardless of the relationship between the rapist and the victim. They could be complete strangers, or acquaintances, or spouses. It doesn't matter.
To say that marriage justifies rape is one of the most preposterous things I have ever heard.

Girls even today marry because their parents ask them to (and girls do that for their izzat and stuff like that) when they actually don't want to do that. In cases like this, touching a girl's body can be against her will.Why does this not constitute as rape? Just because we freaking married the guy? We married him. Marriage is not permission for sex.
