Well, the chances of gaining US citizenship seem quite bright through the asylum application as compared to the more arduous conventional route : ) I don't see why it would not tempt some to exploit this easier route. It doesn't take too much effort or imagination to play an exploited victim. Given the economic wage disparity and the near impossibility of some countries to honour the minimum wage policy set by US it would be a much easier and cheaper way to gain a permanent stay in US. I am assuming that the legal help in obtaining asylum is being offered free of charge to the "poor mistreated victims"

$4,000/mo is the average salary even most US FSO's earn. Maybe not $4500, maybe not even NY minimum wage of $9.00/hr, maybe not even national minimum wage of $7.25/hr. Tons of people make less than Devyani and still manage to get child care and home help without exploitation.

Alright I would be happy if someone can help with few of the questions:-
Hades- why asylum because in her complaint Ms Richards has not mentioned mistreatment or work harassment as the basis of her complaint. Check the complete statement issued by Preet, she also met the Diplomat at the State district court in July and demanded a fresh passport + valid work visa and , $10000 from here to reach a settlement.
Another Devyani signed a contract with her before she landed this job which made it clear about her wages. She knew the minimum wage handed by American laws also , so why did she agreed to these terms.

State attorney has stated and I use his words - US evacuated Ms Richards family even when Indian courts were prosecuted them. This before the arrest was made. There was 9 months litigation against them and also filed by them in Indian Courts then how were they cleared for the visa ? why was Indian law not respected especially as their charges were made on Indian soil.

Now , tell me how does a US attorney not only has a right to comment or pass judgement and take actions which differ with Indian Judiciary. Does he feel morally responsible for every down trodden of India as well?


The supposed notion that Devyani was earning high salary is completely ridiculous, please check the Planning commission of India. My issue if Ms Richards was sponsored this work visa, why did the US agency didn't cross check the employer's pay slip or did they too turned a blind eye and be party to this visa fraud.


Kerry in his statement and his phone call has regretted the treatment meted on Devyani. If according to you there is normal standardized treatment followed here then why the regret.

MEA has gone on record to say that no security measure is removed from any diplomats including US. India has just become stringent with the laws. The checkups on relatives of Diplomats who were ignoring laws and were employed in all the International Schools here are being rounded up.

The point is there is a reason why the word diplomacy was invented-it covers such incidents discretely fringing the latitude of understanding and cooperation otherwise the whole balance shift of world politics would blow up.

Hades- Read Vienna Convention 1961,1963 - it covers diplomatic immunity for consular duties as well as stresses that in no circumstances diplomats should be mistreated. I don't think we should agree/disagree on this statement on just prosecutor's case while not even reading the defense statement.

According to International Community of Courts, usually it is expected that countries respect another country's court's injunction .Us has enjoyed this understanding with India in the past and till now as well. Yet when Indian Court issued an injunction in June. , US should have respected that but it ignored it.

There was no show cause notice issued by Preet to the diplomat , a standard by the book practice implemented by every nation. Again US seems to be above International laws.

I am further surprised that we are ready to call Devyani guilty without even hearing the defense and just taking the State Attorney's statements as the facts. Are we not playing Judge here. Let the court decide and hear on the case, before we call anyone guilty or victim.

Hades- Raymond Davis case, wow you really think US didn't put any diplomatic reciprocatory measures, very very contradictory to what Foreign Minister of Pakistan stated. Read the argument presented the tone and the text matched or probably surpassed Indian stand.

With Kerry's latest conversations with NSA. I do sense a quiet transfer of Devyani. we have got the regret out , lets see how the others play out.

Then divyani should also get a salary of 1/3 of a US SFO earn . Her salary is on indian standard a 4 lakh excluding accomodation and all other benifit bear by govt that too a govt. job. It is strange that an employee want to earn in $ and want to pay as employer on terms of ppp of Rs. that too being a deplomat of a country who represent us blantantly disobey the labour law of the said country. What food accomadation ? that maid live there alone, she take care others kid instead of her. Strange that she want to enjoy US wage and as a employer want to impose indian wage. If she cant manage the said countries law then better she should opt for IAS instead IFS and enjoy life in interior india.

Read the case document PDF. This was investigated and proven. The second document was coerced in USA when she was at her employers mercy.

USA secured material witness to their case. Case document PDF has husband as "Witness 2".

Hades - A husband as a second witness . Read this statement again, were any other diplomats from India or legal aids involved referred as witnesses considering the case has been stretched for 9 long months. Still this is prosecutor's document , have we equally read the Defense argument over the same issue! As I said , wait for the court or the US state office before we use words like guilty or victim.

Would be very interesting to see how US handles this one But yeah All for the Justice and for the victim, Hair Uncle Sam.

Aww. this is highly regrettable Genie :)

And this you infer without reading the cases or waiting the judgement , you do understand you are putting question mark on an independent court which issued the injunction. I would love to read about the arguments from you which the honorable Judge failed to see. That and they should not be based on Power and powerless argument only.

My only argument is that the judge who sided with the Khobragades and issued the gag order is not so honorable.

Phew! Agree .l Let us see what the coming days narrate. Would visit this conversation when this matter is sorted. Too early to form assumptions or to read things on their face.
