He did not hit anybody...but he threw water bottle on table and it went to hit ...either bhaktiyar or vindu...dont remember... he was not targeting anybody...just venting out his anger with throwing away bottle...that is why he was evicted

The police does not know the law, so they will not watch the videos to understand intent and legality. They will just see if there was any physical contact. I he is taken to the magistrate, it is the magistrate who will see if prima facie the charge of assault has been fulfilled or not. Intention might be analyzed at a prima facie level alone by the magistrate. Then chargesheet will be filed and then investigation, trial etc. As per my understanding of the law (which is pretty good given that i do it for a living), this entire arrest is laughable.

Moreover, those getting happy on principle also- let me ask you- with so many real crimes happening and going undetected, don't you think this is a frivolous charge, a waste of resources? Police resources could have been used elsewhere where crimes are really happening. This is not to say that he did or did not hurt her- everyone is fully within their limit to have an opinion about his wrongdoing. But this is not worthy of a charge.
