also, what happened? stories from mahabharat dont work no more? what did Yudhistir say? yes! that criminal culpability and punishment should be based on how informed someone was. dont judges and lawmakers swear by the geeta? what gives now? geeta is good enough to swear by, but the underlying principles dont work for them?😉😆
actually, dont even have to go that far back. he was absolved of terrorism charges, so he should have been sentenced in a non-TADA court where he would have gotten off most likely on a probation. sort of silly to say that well this is the rule, so it's fair. that's a cop-out when folks cant think for themselves.😉
and then, there are other ways to look at fairness. just because this judge decided to hand out 6 years to everyone does not make it fair. what if he had handed out 50 years to everyone, assuming it was permissible? would that have been fair too? he just might have if he could to burnish his anti-terror credentials. who knows what constituency he wants to join tomorrow?😉
want more? well then, how about comparing the severity of his violation with crimes committed by rapists and murderers. 6 years then sudddenly begins looking like a very long time, no? unfair too, no?😉
oh, all that other stuff about alleged conversations with gangsters etc, cant convict folks for that. we'd have the PM behind bars that way. 😉he sure must have had many a conversation with shibu soren, his erstwhile cabinet minister.
lots of ways to look at fairness. character witnesses, charitable work all are taken into account in most evolved judiciary systems. cant say something is fair unless in a very narrow copy-cat sense if the system is primitive or it sucks.😉
