According to the Madras High Court if a couple indulges in premarital sex it will be considered marriage!

This judgement was given because of a couple who had not married but had two children. In order to make the man pay a monthly maintenance of Rs 500 to the woman, this judgement had to be passed where in a couple who lives together and has kids should be considered a "married" couple.

But this does not mean that just because a couple have sex before marriage that they are automatically married! By that logic more than half the population of this country are married! Do you agree?

Judge comments:-Justice Karnan said: "If a bachelor aged 21 years or above and a spinster aged 18 years or above had premarital sex with intention to marry and subsequent to this the man deserts the woman, the victim woman can approach a civil forum for remedy after producing necessary substantial evidence to grant her social status as wife. This remedy is not only for the purpose of giving relief to the victim woman but also to maintain the cultural integrity of India."

Justice C S Karnan has further elaborated on the order which accords the status of marriage to all such relationships, and said his ruling would help maintain the "cultural integrity of India" and "protect the welfare of women".

What about when a women goes and have multiple sexual partners without being married?So will the man get the right to go to court and pronounce her as her wife, so that she becomes married!

What will be the fate of the live in relationships of a person with two or more women simultaneously or one after other. Similarly will the person be convicted for more than one marriage or otherwise.

This is not the whole thing. Read here:


Both parties can get a certificate of marriage by giving proof of their sexual relationship ONLY if both want subject to certain conditions. It's a good law for protection of both parties esp. women.

How exactly would one produce such proof, one that will hold in court? Eye witnesses that can give affidavits of support? Video tape evidence would hold the best me thinks. 😆

Really though, I can already see many applicants being turned down for insufficient documentation.

I think people are misunderstanding and misconstruing this issue.

The goal of the court is to offer some protection to people in long term sexual relationships, especially for women and children born out of wedlock. The overall intent is good, but the approach is incorrect. Marriage shouldn't be an afterthought of sex and children, but a more serious commitment. Rather than try to implement a new definition/means of marriage, I'd like to see paternity and maternity laws – that dictate rights and responsibilities on both individuals who have a child out of wedlock.

Its a generous verdict. To provide due legal right to children born out of wedlock. Seem to be some ambiguities in the verdict. Documentary proof for sexual relationship???? Honestly I didt expect such a sensationalised piece of s**t from The Hindu. Highlighting some parts of observations made my the Judge. They could have waited for the Judgement.

If a couple does not believe in the legal necessities of getting married why should they want legal remedy to any problems arising out of their choice to co habit without any strings attached?
