NEW DELHI: Delhi gang-rape victim Nirbhaya's friend and sole witness in the case, who had earlier accused the Delhi Police of delay in rushing her to hospital as the PCRs that reached the spot argued over jurisdiction, has backtracked on his statement while appearing before the Justice Usha Mehra Commission looking into various aspects of the horrific incident.

According to Justice Usha Mehra, who on Friday submitted her report to law minister Ashwini Kumar outlining the lapses on part of various agencies that led to the gang rape, Nirbhaya's friend denied any delay on part of the police in reaching the spot. In his statement, the software engineer said the PCRs had reached on time and immediately rushed her to Safdarjung Hospital.

Justice Mehra said the young man made a statement that was contrary to whatever he had said earlier in an interview to a private news channel. He denied around half-an-hour delay on part of the PCRs to reach the spot, saying that he may have gone wrong with his estimation of time as he was traumatized seeing his friend lying in a pool of blood beside him. "Every minute looked like an hour at the time," the former Delhi high court judge quoted Nirbhaya's friend as saying.

Justice Usha Mehra confirmed that the Delhi Police PCR has reached the spot within six minutes.

However, she faulted the Delhi Police on two counts. First, there was no police picket or PCR van present along the route taken by Nirbhaya to intercept the bus. Second, the Delhi Traffic Police, despite issuing challans to the bus many times, had failed to inform the Delhi transport department.

This ensured that there was no action or impounding of the bus, and it continued to ply. The retired judge suggested all hospitals, including government and designated private sector ones, have a dedicated centre to aid rape victims, equipped with a gynaecologist, nurse, lady police officer (preferably of IG rank) and forensic expert.

Metropolitan magistrate records statement

The metropolitan magistrate, who had recorded the statement of the victim in the December 16 Delhi bus gang rape case, on Friday testified before a fast track court trying the case.

The magistrate had recorded the victim's statement at Safdarjung hospital after the statement recorded by the SDM had run into controversy following the allegation that a Delhi Police official had interfered with it. The metropolitan magistrate deposed as a prosecution witness during in-camera proceedings against the five adult accused, who have been . The sixth accused is a juvenile who is facing trial before the Juvenile Justice Board.

Delhi gang-rape: Sheila Dikshit highlights need to rectify loopholes in police functioning

Delhi Chief Minister Sheila Dikshit on Saturday said that there is a need to rectify the loopholes in the police functioning in the national capital.

Delhi CM was referring to the Justice Usha Mehra Committee observations, which was constituted to conduct an overall probe into the Delhi gang-rape case that aroused spate of protests across the country in December last year.

The panel headed by Justice Usha Mehra, submitted its report to Law Ministry on Friday.

The report has pointed out numerous loopholes in the functioning of Delhi Police and also the transport department.

On these aspects, Dikshit said that the suggestions of the committee should be taken reckoned in right earnest and implemented too.

"This is an opportunity for us to rectify the loopholes as someone has pointed out. We have said many times but we are unable to do it. But now, when the report of the committee (Justice Usha Mehra Committee) is out, it should be implemented in my view," said Dikshit.

The committee has declared that there was a lack of co-ordination between the Delhi Police and the Delhi Transport Corporation (DTC).

It also noted that without proper verification of the antecedents of the owner of the bus, in which the 23-year-old victim was gang-raped, the bus was granted the permit for inter-state carriage operations.

The report has blamed the DTC of renewing the license of the bus, which was penalised by the police on several occasions.

The panel has also recommended the government to amend the laws relating to the hearings of the victim.
