Who should decide a child's guardian?
When should a child of separated parents be allowed to choose which is his or her legal guardian?A British girl says she travelled voluntarily to Pakistan to live with her Pakistani father, brother and sister. Molly Campbell had been missing from her home in the Western Isles for a week, and there were fears she had been abducted.
Her mother and legal guardian, Louise Campbell, had made an emotional appeal for the return of her daughter, but the 12-year-old says she now wants to be known by her Muslim name, Misbah, and doesn't want to return to Britain.
How much say should a child have in choosing who to live with? Have you had to choose between parents, or been involved in a child custody case? What is the most important consideration when deciding where a child should live?
"Children under 16 year olds should have a SAY, but not DECIDE. The decision body should take into account reasoning from the child and make a judgement if the reasoning is his/her own or is it through others' (e.g.one parent which has greatest influence) or through the childs' pink coloured specticals.
