Does the Government of India have the right to fix an age of consent for sex? Or should that be left to the individual?

I'm indifferent towards the bill the govt. has passed..
It's good in a way, as in good for the judiciary, because there are many cases of 'couples' where in either of them(usually the girl) is young, below the age of 18 and the couple elope and 'marry' and then have sex --- all this is purely illegal and hence, if having sex below the age of 18, consensual or not, will atleast prevent people from eloping 😆 ...atleast that's what I think, because if we see the cases that ushered the bill through the parliament, it's the case of some couple that eloped :)
Also, there's many cases where the girl alleges the older guy of raping her minor innocent self, whereas the guy goes on to say that it was a consensual one. Put a restriction on having sex below 18! nothing doing!! 😆 ...the sensible guys would be careful before they lure/get lured by a girl now :P
However, whether it's right or wrong to make such a law... the PCSOA(Protection of Children from Sexual Offences Act) is futile. How will the cops know that two people are having sex unless one of those two people or their parents lodge a complaint on the other one, or unless there's an evidence - video etc? 😆 And, I dont think girls can get pregnant, most of my classmates have never got pregnant inspite of "doing it" pretty frequently 😛 kids these days have easy access to contraceptives, etc :):) ...it really isnt very much easy to implement this law...anyways, let's see, how the law is above all.. as the consititution reads.
The reason behind the govt. coming up with this Act - Proctection of Children from Sexual Offences is out of their concern for the society and parents, my opinion is, parents themselves fail at getting their "values" across to their own children, how will a law prevent kids from doing things? Having sex...whether for the fun of it, or because you seriously are in love is all a very personal thing, depends on the values, morals, ethics of the kid.
Finally, I can only say that, every person has the right to do whatever he wants with his body. Kids have brains, they can use them... i feel, the more you put restrictions, the uglier it all gets. People should have freedom...not like this bill is gonna cease any of it, all the kids who want to have sex will do is - be more careful, not let anyone know, take precautions 😆
But no matter how many precautions one can take, it's a risky affair to go against the law...and the law is CRIMINALIZING all sorts of sexual activities between kids below the age of 18, unless the kids are legally married. So, sensible ones can always wait...think of the repercussions of going against the law. Critizing the law wouldnt help now :)

My opinion: When you are feeling happy, celebrating, and you would like to share ur energy with somebody you love, go make love...if two lovers doing it ..then its a natural phenomenon nothing wrong in it... In india's big cities any collegian will tell you that pre-marital sex has become more common now... but its true that,Indians or Desis still lose their virginity much later than people from other countries..report says that average an Indians are 22 years old when they lose their virginity...whether the couples are being "immoral" or not is best left to the couples own morality and sense of right or wrong...😊

It is the Government of India's work to impose laws, whatever they are. What I don't understand is, how will they find out if an individual has sex before the age of 18? All mishaps don't end in unwanted pregnancy, now do they?

It's more like, it is for the individual's mental and physical state to decide. They need to be aware and ready. It doesn't matter if they are below 18 if they know what they are doing. But then again, such laws have to be imposed because 'people don't know what they are doing'.

For example, you can't consume alcohol legally before you are 21 in some states of India, others need you to be 25. Some simply state that any import or export of alcohol there is banned. But as it so happens, alcohol is not only available in such states, people way below the legal drinking age do drink. The ones 'who do not know what they are doing' again are the ones who drink gallons of alcohol and think it'd be hip to drive after that. That's why there is a law.

So, we could relate this with why there is a legal age for an individual of our country to have sex. 🤓

I think 16 is fine. But marriageable age should be 18 and same for both the sex, unlike the present situation.

It's strange, because my great-grandmother was married off when she was 10. She went to live with her husband a few months after she turned 13, if you get my drift, and had my nan when she was 15. She later went on to have another boy at 19, and both mother and son contracted tuberculosis and succumbed to it.

Age of consent? What bloody age of consent? Most people will choose to become sexually active after they've hit puberty, and since different people hit puberty at different ages, the idea of an 'age-of-consent' sounds risible.

If you absolutely MUST, then 14. 16, at a pinch. Anything higher is ridiculous, not to mention self-defeating.
