Does sleep-sex account to rape? Why?

I write this topic with all intention to spark a fiery argument in the debate mansion which the section had been missing. Don't know how far it would do the trick.

The topic is which I intend to put forth is controversial and sensitive. It relates to 'sex during sleep', where a personal involuntarily involves himself in sexual acts while he's asleep. Medically, the condition is known as Sexsomnia.

Sexsomnia can occur as one of the sleep disorders apart from sleep walking, sleep apnea, night terrors and bedwetting and can be triggered by stress, previous sleep deprivation and over use of alcohol and drugs.

Such acts can include masturbation, fonding themselves or others, having sex with another or even sexual assault or rape in extreme cases.

Now, should it really be assumed as 'Rape'? Having said that, sexomnia is unintentional and uncontrolled? Does sleep sex after marriage account to un-consensual sex?

more like unconscious sex rather than un consensual sex..

hmm, I do think it's a crime, but the torture happens afterwards rather than during sex.

I dunno, the image of rape in my mind is some rogue snatching a girl and making her have sex with him with her knowledge.

Studies says that,sexomnia, a condition wherein sleeping people attempted to initiate sex with their partners...dr's says its a disorder..
if any girl has this disorder ..😉😛😆
I would not call it a "disorder"...Like to say its a gift or smthing..😉 People act out their dreams sometimes..could be due to stress, or psychological issues..😊

Without going into the details of this disorder there are two ways to look at it
1) A person physically interacts with another in state of sleep and therefore did not commit the act consciously. Therefore according to definition of rape it was not committed through force/duress/threat and hence not a rape.
2) A person suffered from this act without giving consent and from her point of view it does not matter whether the other side was conscious, sleeping, on drugs, drunk, not in control etc. To her it was without her consent and therefore forced if not threatened and hence rape.
Answer lies somewhere in between. Its like a manslaughter charge where people get away with even killing other because they did not do intentionally. However first we need to establish that the act was indeed this and not some act by a cunning person acting as if he was in sleep. I am not clear on this at this moment. I know a little but not sure.

What % of population suffer from this disorder? The burden of proving the disorder would be on the accused.

"Shakky Bro" had noble intentions to bring back life into dead mansion. However it seems this topic has also reached a dead end and so has "shakky bro". lol. Lets pray that he comes back from the dead with another janam or maybe his aatmaa as another ID. He can then continue with this noble deed.
It was kind of him but it seems that all debate topics have been exhausted. Also the master debaters are no longer here. Then non-serious debaters like me have found a place here. The result is debateless mansion lol. Oh those glory days ..

And I thought I was going for a serious debate on sex...😆

Anyways, are you too embarrassed to tell your partner what you like sex wise, and instead play it out in your dreams and just maybe these are the reasons why virtual reality sex (phone/text/video) is an increasing phenomenon and birth rate is falling 😆
