DBSK Hero, Micky and Xiah's official stand about their discord with SM

Idol group Dong Bang Shin Ki's members Micky YooChun, Hero JaeJoong and Xiah JunSu finally revealed their stand about their problems with SM Entertainment.

Their representative revealed through news media on 3rd August, "The 5 years period after they debuted, the 3 of them felt that their minds and their bodies are tired having to follow the tight schedule that the company put up unilaterally."

They continued, "Kim JunSu, Kim JaeJoong and Park YooChun has been following SM's instruments from beginning of 2004 till now, going back and forth promoting in Korea, Japan, China etc, and in a year except for 1 week they get only 3-4 hours of sleep a day to do our schedule."

Also, "In the process the health of the 3 members are very much deteriorated, they are also suffering from mental fatigue, and as time went SM continue to established on their own decision for Dong Bang Shin Ki to advance into other countries. In the end the 3 members felt that as compared to be fulfilling their dreams to be singers, they are used more as a tool by the compared to earn profits, and they wish to use each of the members to also go into other entertainers' activities."

The 3 members' representative also added, "It is a 13 years contract but in reality it is a lifetime contract. With the exclusive rights clause in the contract, the 13 years also include the time the members are serving their military service, hence it will go for more than 15 years. And now it has not even been near to 10 years since the group's debut, hence it seems like the contract will last until the members' retirement from the entertainment zone. The penalty for retracting the exclusive right clause is 3 times the investment cost and 2 times the lost in earnings. They also asked about the penalty of cancelling the whole contract but it will involve several hundred billions KRW of penalty, hence in reality there is no way out but to be tied down to SM because of the contract."

Also, "The members did not receive the right treatment even from SM. Without getting any contract fees, the initial contract was that if their album sells more than 500K copies, each member will get about 10 million KRW during the next album release. If they sell less than 500K copies of album, they will get nothing."

The 3 members had went down to Seoul Central District Court to file for a retractile of their exclusive belonging rights with SM Entertainment on 31st July, causing an outrage of speculations about the group's disbanding and also problems between the members and SM.
Oh SM! you disgust me like no other 🤢

Ever since I found out aboutt his I feel so sad for DBSK !.. I never realised how much of a strict/harsh company SM was until this started and what they did to Shinwa.. I honestly pray that they don't split but also I honestly would love for them to leave SM if they are treated like this *Personally I wouldn't mind seeing them join JYP or even Rain's new company*.. I just pray that this will be solved soon ! *fingers-crossed*

[NEWS] DBSK's Dispute, Causing Stir in Music Industry, "Not Someone Else's Business"

5 08 2009

As DBSK dispute continues downhill, the music industry has begun supervising their own. The possibility of a 2nd or 3rd DBSK dispute is causing a crisis in the music industry.
Seeing the members they once created and nurtured to be top Asian singers, now fighting with their company is a bitter sight to see for the middle management executives. However, as Xiah Junsu and other members have revealed the unjust contract conditions, some are saying that this is the time to self-exam and improve. How is the contract conditions for groups other than DBSK.

Super Junior, Girl's Generation, longest contract is 13 years

Other idol groups in SM entertainment is being targeted first. It was reported that for Super Junior, Girl's Generation, and Shinee, contracts are different for each members but the contract periods are anywhere from 5 years to 13 years.

Because some members of Super Junior and Girl's Generation have different debut years, their contract is individual.
Before Kangin became a member of Super Junior, he was a VJ for a entertainment news program. Before the release of Girl's generation album in 2007, member Sooyoung made debut in a duo 'Route Oh" in 2002 under SM Japan so she signed a contract before the other members. Because the contracts are individual, earning distributions and schedule conditions are different for each member.

One Super Junior member spoke with IS on the phone stating, "even if I want to move to another company, the remaining terms of the contract and penalty for breaching the contract is far beyond than people imagine. Because we have a lot of members in our team, we have to divide our earnings into 1/13, so we do not make much money. Up until recently, SM tried to make it our responsibility to pay for our stylist but a senior member took courage and corrected it. There are feelings in the company that if you do something that the company doesn't like, it is only your loss so even if we have complaints, we can't express it well."

It was reported that they had a meeting with each other after the DBSK dispute became a controversy.

Music producers state "they don't even know the situations"

Another artist under SM Entertainment stated with affliction, "DBSK sunbae's dispute is bitter to watch because it seems it our future is being shown. Trurthfully, there are too many things on my mind that I can't concentrate when I'm performing on stage or doing other broadcasting schedules."

For one group of singers under an entertainment company, although earning distributions are clear and there is strong confidence between the company, they signed a contract period for almost 10 years and are anxious that this might spark something in their way.

Jang Yoon jung and Park Hyun Bin also signed 10 year contract with their company and although Jewelry members have different contracts, members have been working under the same company for over 8 years. They stated that the problem is mutual distrust, not the contract period.

As the long period contracts are arising as a problem, music industry producers respond that they don't even know what the situation is like. They stated that as singers debut younger and younger, it is becoming normal to start training elementary school kids and if companies continued to meet the demands of its artists, the company would not be able to survive.

One entertainment company president stated, "I am paying attention to how the provisional disposition will be ruled. I feel like singers do not consider the company's perspective and are only considering these situations once they have become famous. I hope this will be an opportunity to eliminate troubles between singers and companies."

When I first heard the news (I wasn't even looking for anything DBSK and I happened to come across from it), I was shocked... and at first, I didn't want to believe anything. But after article after article, I realised that there IS a lawsuit going on. I was really worried at first but the thing I have always been confident about, even before this lawsuit thing is that DBSK will not disband. I have full confidence in that... this lawsuit has nothing to do with them disbanding, with conflicts between the group themselves, it originally had something to do with Jaejoong, Junsu, and Yoochun wanting to fix some exclusive clause in a contract and now so much else has come up... the thing that upsets me most is that I have seen no apology from SM, apologising to the fans atleast just for all this worry and anxiety all this has caused... and that they continue to want to place the blame on DBSK. The amount of money DBSK is earning (though this amount keeps changing) is certainly not very fair, and... I just wish that SM would realise what they are doing is wrong and try and WORK with DBSK and figure out something through a negotiation. At this rate, we don't really know what SM is going to do... though so far it hasn't seemed like they have been reasonable.

Gah! I'm really wanting all of this to be over, even SMTown has been postponed for now and we don't know what is going to happen... I will be really sad if DBSK leaves SM because I love the SM Family, but if they are going to get better treatment by leaving SM then that is for the best... though I don't want to think too ahead and jump to any conclusion. Just hoping for the best and hoping DBSK will get something in their favour... and even though Yunho and Changmin have not directly said anything I know they are supporting the other 3... I think it just shows 😊 DBSK together always, they will remain as 5! Fighting! :D
Phew, sorry for all that rambling! I'm not even sure if what I said makes sense but just wanted to say it... :)

I hope tvxq doesn't leave SM either. I love SM family. It is so nice to see Dbsk, suju and Shinee together. I wouldn't like it better any other way. I have even come to like SNSD a lot.
