Tvxq's lawsuit against SM--thoughts??

for those of you who don't knwo the deal it is that SM keep most of the profit...the ratio being 8:2 or even 9:1. Tvxq is currently under a contract with that which goes on for 13 years. There is an "exclusive clause" under the contract which stops the member from doing basically anything SM wouldn't want them to do.

So Xiah, Micky and Hero filing a lawsuit..(or they have already filed one..don't know)

I am proud of the boys taking a step foward. I mean it really is a "slave contract" that they are in, and the ratio is just pathetic. And there are fans worrying about the group disbanding, but seriously that is not going to happen. First of all, I dont think sm is that stuipd to actually let the jewel of their empire go, I mean they generate the most profits for them in their company. Plus, Avex is directly connected to sm, and sm lets the boys go, avex is not going to happy, and this will create more court problems. Well, this my view. Things looks better than there were since the morning time. Hope this all works out for the good.

One thing that did blow my top was Junsu being "bullied" by some of the sm heads because his dad was helping the boys out. I mean really thats enough.

And I believe they already filed a contract. I cant wait to see them perform tomorrow for A-nation.

[NEWS] With Worries About DBSK's Disbandment, Chinese Fans Join In The Fan Panic

It seems that the Chinese fans have also joined in the fan panic with the news of danger that Dong Bang Shin Ki will disband.

On Chinese Sina.com and other media, there were reports about Dong Bang Shin Ki members Xiah JunSu, Micky YooChun and Hero JaeJoong going to Seoul Central District Court to apply for provisional retractile of their exclusive rights effect from their contract with SM Entertainment.

It was reported, "With this news of a lawsuit by the Dong Bang Shin Ki members, many of Dong Bang Shin Ki's fans have been taken aback, especially for their official fan-club Cassiopeia, they are in a panic state."

With these reports, Chinese fans said, "If this is the route they choose, we will support them", "But still this is the company that groomed them to be top stars, isn't that a little too much?" with various responses.

Meanwhile, it has been known that members UKnow YunHo and Max ChangMin has decided not to join the rest of the members in this pending lawsuit.

With these news, there have much speculations that the chance of the group disbanding is high since it has been more than 5 years since they debuted in 2005.

But with that, SM Entertainment released official statements:

    They said on 1st August morning, "It is true that Xiah, Hero and Micky made the application for provisional disposition to terminate the exclusive rights effects from their contract on 31st July at the district court. With that the company is very taken back by the action, we are trying to get confirm all the truth from them currently. " They continued, "But as a representative group to the country and to Asia, our stand is that activities for Dong Bang Shin Ki have to continue even with this disposition application. And about the problems arising from the discussion to do a cosmetic entreprise, we plan to talk over them and sort out the problems as soon as possible."
  • SM Entertainment's representative added about rumours to the band's disbandment, "On SM's side, we still have much love for Dong Bang Shin Ki. We do not want them to disband. Let's resolve this peacefully seeing the long time we have worked together since their debut till now."

im soooooooooooo shocked by this news.. seriously.
There was an article on allkpop that said its difficult in times like this for a band to stay together - Experts say that.. not SM or DBSK themselves.
I hope they ALL move to another company like JYP or something lol (actually i dnt know if they are any better) the disbanding is a terrible thought... its gna happen one day but not now..
Its like when i heard 'Friends' was goin to have a last season.. then their last episode and how upsetting that was

of course everyone is remembering the H.O.T and Shinwa incidents. I am scared. 😭 I even had a dream about them..and it's rare that I see them in my dreams.

I don't think they want to leave SM...but JYP profit ratio is 5:5 while SM is like 8:2

SM are to hand in all "account books, the contract, receipts, transfer slips and all other documents" as the members file for a 'preservation of evidence'

It has been found that YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu, members of boy band 'TVXQ', have filed a preservation of evidence request form along with their lawsuit against SM Entertainment.

The Exclusive Contract Validity Suspension and Provisional Disposition Request Form that was filed against their current entertainment agency, SM Entertainment, was followed by a lot of attention towards the uncertain future of TVXQ and many people were curious as to why they also filed for a preservation of evidence request.

Through the law firm Sejong, the three members YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu filed for the preservation of evidence request. This can be seen as an act of gathering evidence in the case that it is found that SM has not been faithful to keeping the contract of TVXQ in accordance with the law.

This conclusion can be made because when one is face with a preservation of evidence request form, they must hand in all account books, contracts, receipts, transfer slips and all other documents related to the parties in question.

However, Lawyer Lim Sang Hyuk from law firm Sejong, who is representing the three members in this case, stated in reference to SM's official statement that, "The cosmetic company, which may have caused some disagreements amongst TVXQ in an emotional point of view, was not the reason TVXQ filed the lawsuit. After reading the official statement of SM that was released on the first of August, we found that they made the cosmetic company a larger issue than what it actually is. It is wrong to think that TVXQ would file a lawsuit just because of a company that isn't even TVXQ's main work priority."

I am actually back to my worry state. I cant believe SM didnt tell the boys their exact income for all these years. And I hate the fact that the korean media is actually putting a lot of fire into the issue spreading stuff of the boys separating into two groups and some fans are actually making up stuff. For example the UFOs released today that were claimed to be written by Changmin and Jaejoong were actually written byfans. Atleast, A-nation went well today.

Yeah, fan accounts say they were all engerized and smiling.😃 I know na. I have a separate money saying account just for them...I hate waiting, I wish it was resolved already, but its not that easy.

well I'm not a DBSK fan (i never really got into them) but I can see how fans can be panicked....heck if Big Bang ever talked about disbanded, I'd probably have a panic attack myself but I am happy they're trying to fight for what they deserve...from what i've read, they've pretty much been cash cows for SM....its not fair to them or their families....artists always put in alot of work and sacrifice alot to get what they want..i hope it works out and they don't disband, but I do think it would be hard for them to continue without SM Entertainment....SM's got alot of power over tv stations and such...he could make sure they don't appear on any shows.....apparently he did this with Shinwa as well......If they do decide to sign with another big label its going to create ALOT of problems, so I don't really see YG or JYP signing them on... we also can't forget, they may have reached a point where they want to do individual things....explore being an independent artist rather than being in a group...I know it it sucks for DBSK fans, but they've been in the industry for almost 6 years (the max point for most bands is 5 years) there is a limitation point..unlike YG where he lets Big Bang do their own thing while being in a group (ie. Taeyang's solo album)...SM always keeps their artists from doing independent things (which is one of the many reasons this lawsuit came into place).......fans should just think about that...
