If people were to claim depression for kidnapping kids and then sue the parents then our courts would be running biggest kidnapping racket by aiding kidnappers

In this case, the courts will take her condition into consideration and may have her evaluated before reaching a conclusion.
Ruhi can sue Abhira for emotional distress, but she is not entitled to any punitive action against Abhira, as the child was returned without harm. Legally, you can either sue for emotional distress or claim damages, but not both.
