Ruhi will anyway get Daksh because she's the biological mother. Unless she's physically abusive or unable to care for her kid financially, even then court will consider her as the first preference. She has to be mentally unwell for the court to not rule in her favour.

@b: verbal consent matters if anyone can bear witness to the fact, otherwise it doesn't. If they can prove that Rohit gave consent, then the case won't stand.

No, Abhira won't be prosecuted. She did not kidnap the child according to the law, because the child's father himself consented to the baby being in Abhira's care. If Ruhi decides to sue Abhira, pehle Rohit hi phasega because he didn't take consent from his wife. After that, it will be Armaan, and then Ab. Also, Abhira can claim temporary depression for her actions. The other two will be the ones who will have to face jail time.

As far as I understand the law, with a good lawyer, (not someone like Armaan) not only will the case be overturned, but Abhira can also countersue Ruhi for defamation of character lol.

Abhira kidnapped the baby "after" it was revealed that it wasn't her baby, the child was with his mother Ruhi and Abhira came to Poddar house and ran away with Daksh

There was no consent of Rohit for anything because the child was with Ruhi and Armaan had revealed the truth to Abhira in front of everyone

Everyone was in the know of Abhira's knowledge of the fact that it wasn't her child

If people were to claim depression for kidnapping kids and then sue the parents then our courts would be running biggest kidnapping racket by aiding kidnappers

I don’t understand why Dimbri is so desperate and adamant about staying with dadi, leaving her husband and daughter with in-laws.. why can’t Manisha and Manoj take care of dadi.. they are more responsible for her security than this overacting dukaan. In one way, I feel Vidya is indirectly pressing Dimbri to come back to ph by taking maira away.. I’m sick of Kiara’s presence.. I don’t like her from the beginning and now her pregnancy track is so irritating to me to watch. Law doesn't work in our favor just because we don't like someone lol.

The fact that it was Ruhi’s husband who gave the consent puts him in legal hot water, so to speak. Apart from that, courts also consider something called intent, which plays a significant role in civil actions. Not everyone can claim depression as a defense. In this case, the courts will take her condition into consideration and may have her evaluated before reaching a conclusion.

Ruhi can sue Abhira for emotional distress, but she is not entitled to any punitive action against Abhira, as the child was returned without harm. Legally, you can either sue for emotional distress or claim damages, but not both.

Honestly there’s no need for a third angle as Kachra Kappal will anyway end up reuniting

Speaking of third angle, what if Abheera has another child but then dies like Naira, then Ruhi returns and takes care of the child and Maira like Sirat.

Agar aisa hua toh saare bacche Ruhi ke honge. Daksh whom is her own, Maira who she birthed, and the new child whom she will raise..
