Yes legally the Biological mother has first rights I’m not denying that. But law also looks at the welfare of the child, especially when the child is 7 years old and can express their wishes. Maira has lived with Geetanjali for 5 years that’s most of her life. Geetu didn’t snatch her Armaan brought her into her life. She raised Maira, gave her a home, and Maira herself wants Geetu as her mother. Courts don’t ignore emotional bonds, especially when shifting custody suddenly could harm the child’s mental well being. So even if Geetu doesn’t have papers she’s been Maira’s mother figure far longer than Abhira has been around in her life recently.

We Can see in Yeh Hai Mohobatein show scene where Ruhi wants To live with Ishita Despite Shagun and Raman Being Her Parents. The Court Granted Ishita Ruhi's Custody
