The article mentions reissue of birth certificate in case of malice or parental neglect not that the abusive father was victim lol. Akshara can easily show that there was no neglect or malice on her part. Her call records would show that she did call him. The court would get to kmow that victim doctor kicked her out without ensuring further medical care for the miscarried foestuses (one of which was Abhir presumably) and construe it as parental neglect on his part.
FYI, the parental neglect SC is referring to, in that TOI article, specifically means neglect to register the birth of the child, and not a mother's choice to not inform the biological father.
