Text messages too can be tampered with. Happened in the famous Pramod Mahajan case. They proved in court that messages canโ€™t be relied upon.

Aryan Khan had been charged with various sections under the NDPS act including Sec 37, which is non-bailable. FIR(First Information Report) has been filed. Charge sheet is pending I believe.

Considering that something like 70% of the people in Indian jails are awaiting trial I canโ€™t argue that bail is the norm. But I can argue about how the law is written and what is intended. The law says even a lower court can grant bail unless there are specific exceptions such as reasonable grounds to suspect the accused is guilty of a crime punishable by death or life imprisonment (and other exceptions like flight risk or threatening witnesses - the usual gangster stuff). There is nothing I see in the statute that would apply in this case (even if Aryan were found guilty of what NCB hopes to find evidence of the maximum sentence is 10 years and a fine). So he really should have received bail even in the lower court. The higher courts can and do grant bail to people accused of heinous crimes while they await trial https://timesofindia.indiatimes.com/india/bail-not-jail-norm-not-for-gangsters-sc/articleshow/82237622.cms

Not only can lower courts grant bail for non-bailable offenses they can and do grant anticipatory bail before the investigation is even finished or any charges filed (also learned from my IF law education vis a vis Kangana accusing Pancholi of rape).

Obviously SRK has far more weighty matters than checking IG stories right now but I hope when this is over someone reminds him about all those who tried to speak out for justice and the many more who didnโ€™t.

Also off topic Iโ€™m proud to be an HR fan when I see things like this. He could easily be one of the people playing safe and staying quiet but he didnโ€™t. He was also one of the first prominent people to post which Iโ€™m sure made it easier for others to speak out after.

I'm not sure what it is that you're arguing. Nobody said Lower Courts cannot grant Bail. Aryan was just in a lower court and his bail was rejected. This is a Bail Appeal in the High Court. But not all courts can grant Bail on all charges. Just in this very case, the local magistrate could not grant bail and it had to be transferred to the NDPS court. I'm in no way justifying the charges, they're ridiculous but atleast one is non-bailable.

4 different police stations. 4 distinct published names. This can be a real revelation.

Hope this would be a story to remember for public, just as he has been trying to remain famous through media by leaking personal chats to sad details of people inside custody etc. since last year (at least what I know of). ๐Ÿ‘๐Ÿผ
