The laws are fairly similar. But Aryans bail has already been rejected in the NDPS court. His custody has also been extended by the same court. This is a "Bail Appeal". Just like the US, India also requires that the accused bought in front of the magistrate within 24 hours so as to not curb their freedom. But in case of an appeal, the accused has to wait. But every Law also has loopholes. The NCB has applied sections of the NDPS act which are non-bailable. The High Court will essentially have to throw those charges OUT to give Aryan Bail. So unfortunately its a little drawn out because its not a simple ruling. But I'm a 100% positive Aryan will get his bail by this judge. Rhea also went through something similar and the judge threw out the non bailable charges like Peddling & Harboring a Criminal. It'll happen this week.
I am not a law expert by any means - though I feel like I may be one by the time this ends ๐ - but I donโt think this is correct. A bailable offense means you have the right to bail and bail is essentially automatic. A non-bailable offense means itโs not a guaranteed right but can be requested and granted from the court even if the charges stand. And as far as I know there has yet to be any official โchargeโ of a non bailable offense anyway and the charges he was arrested for are bailable.
