Just like the US, India also requires that the accused bought in front of the magistrate within 24 hours so as to not curb their freedom. But in case of an appeal, the accused has to wait. But every Law also has loopholes. The NCB has applied sections of the NDPS act which are non-bailable. The High Court will essentially have to throw those charges OUT to give Aryan Bail. So unfortunately its a little drawn out because its not a simple ruling. But I'm a 100% positive Aryan will get his bail by this judge. Rhea also went through something similar and the judge threw out the non bailable charges like Peddling & Harboring a Criminal. It'll happen this week.

I am not a law expert by any means - though I feel like I may be one by the time this ends ๐Ÿ˜† - but I donโ€™t think this is correct. A bailable offense means you have the right to bail and bail is essentially automatic. A non-bailable offense means itโ€™s not a guaranteed right but can be requested and granted from the court even if the charges stand. And as far as I know there has yet to be any official โ€˜chargeโ€™ of a non bailable offense anyway and the charges he was arrested for are bailable.

Bailable offenses are less serious in nature. Non-Bailable offenses are serious charges where Bail is not the norm. If a judge has to give bail in such instances they have to be a 100% sure that the charge does not apply in this case after a stringent consideration, essentially throwing it out because such a charge almost NEVER has a chance in trial and the prosecution is best served concentrating on other matters.

Aryan Khan had been charged with various sections under the NDPS act including Sec 37, which is non-bailable. FIR(First Information Report) has been filed. Charge sheet is pending I believe.

Doesn't the Prosecution always go first in a court hearing?

In both Sessions and now in High, we've seen the Defense go first followed by Prosecution. Is that normal?

As far as I know, in a trial it's the State who has to start the case, the case was filed by them.

This is a Bail application which Aryan's lawyers placed. So they go first.

It's a power play and a long planned one (the basics at least) where the "writers" adjust to the circumstances.

It's a circus play to distract people and each occasion to make the public minds focus on the gladiatorial combat is used.

It's a mind play...who will be the strongest...a father and his son or the evil forces who want to destroy them ...

Twitter/social media/media is the mirror of how easily human beings are to align to a certain toxic thinking...because of propaganda and their own mindset and weaknesses of character...but it also shows what an impact love, logic, resilience & self-esteem can have.
