Bigamy - could Jai be convicted?

Hey

Todays topic amongst my friends was the topic of Bigamy (seriously i dnt know how the topics arise sometimes 😆)

There was a debate whether the 2nd marriage is real or not.. because under laws a man cannot marry another person if they are attached to another spouse.

Under law it is said that the 2nd marriage doesnt exist, right? So are they really commiting bigamy?

Bigamy is when a person has married another.. under laws that marriage is not recognised.. so in laws eyes the person is still married to the first wife, diregarding the 2nd marriage altogether.. so can that person really be commited of the crime when the law doesnt see it as a marriage..

When you think about it..its a contridictin law..

Connecting it to this show Jai married Bani... then a few years later he married Meera, altho Jai perhaps thought Bani had either moved on or had died, he still married when Bani was alive

SAY under law Jai is commiting bigamy.. but can he really be convicted when the marriage is fake.. law may see it as a ceremony only not a contract marriage*

Just realised how complicated that sounded..😆

Anyway i thought it was sorta interesting.. I do not promote Bigamy of any kind at all.. thought id say

*(Ceremony marriage: Where the wedding took place in Gods name and are religiously married.. not on paper.
Contract marriage: Where they are married in the laws aakhe (eyes) 😆 on paper)

I think it's only if its a civil marriage ie marriage registered. I think saat phere wouldn't put JW's bony hide in the jail. May be that what he did, so he could have nookies with both of them.

Henz most women are possessive, can u imagine two women living peacefully in a same house.

My thoughts (don't kill me!)

a. Return of Bani anyway nullified Jai's wedding with Meera
b. Jai could be charged only if either one of his wives filed a case. For example, if Bani filed the case she had to get evidence: a. Jai and Bani were married - wedding certificate and also prove b. Jai and Meera are married. If Women Party filed a case against Jai and if Meera and Bani said they didnt mind - then case again got nullified.
This is law.

Ekta's world: I am sure no one bothers to get marriage certificate. They get priests and family members.

When a person is presumed Dead or missing, the spouse can remarry after a period of 7years if i remember correctly. Not sure if that is the case in India. It is a simple case of the surviving spouse applying for a certificate of death.

But as we all know this is not applicable to any Indian Drama since the writers never think that far ahead.

Well its never made clear if his marriage with either wife was registered or not so in that terms in eyes of laws hes not married to either and if hes registered one marriage and not the other one again its not technically bigamy unless both are registered..also who knows he may have actually divorced bani somehow lol

He is The Jai Walia, so normal laws applicable to an average human being don't apply to him 😆 he makes and breaks rules as per his convenience.

Well, we also have to take into account that he is a high profile personal so press will be all over him so why didn't they do that????.

In real life, yeah, in most countries bigamy would result in a jail sentence.

In KS though, there is absolutely nothing to suggest that our real life laws exist in KS world. If they did, then would the media really let Walia get away with it? 😆

In KS world, it's pretty clear that the marriage is accepted by all - everyone from the law, to the samaaj, to even Bani.

And so, until there is something that is said within an episode that states otherwise, the marriage is legal 👍🏼
