Dev's Second Marriage Track -- Question

Just curious, that whole thing with Dev and Nisha's wedding, weren't Devakshi still married throughout that? Yes they were separated but I don't recall them being divorced since the papers were burnt and then they lost touch with one another.

Am I missing something, did they actually get divorced?

If not, how could have Dev remarried if he wasn't even divorced?

This storyline really confused me
