So it's the same thing! Why put out info so people can prosecute them the very next time such a person leaves a room with another of the same sex?
As long as they don't say it they can at least have a part of basic human comfort even if their freedom is curtailed.

I am not saying they should broadcast about their sexuality. It is their life.
Nuances of law are not that simple. While the Hon'ble SC uplheld the validity of Section 377 in The Naz Foundation case, but the recent judgment on right to privacy gives a right to maintain a same sex relationship and the judgment which is of around 600 pages talks about secual orientation in detail and have stated that right to privacy and sexual orientation are soul of Article 14, 15 and 21.
So, there exists a paradox, now.

I wish. But, again then straight people would engage in sodomy (which is not always wanted by the female partner). Wives have been invoking this section as it is their only saving grace against marital rape involving sodomy.

It is just that Indian law makers suck big time and Constitution is tge biggest proof. 😆
Most of their laws project a paradox.

I don't think anything is stopping straight people from engaging in unnatural sex anyway. Marital rape itself is a problem, whether it involves whichever kind of sex. I don't think wives are happy with getting raped the normal way instead of being sodomised. If it's without their consent, then it's wrong, even if it's just kissing. It can't be a justification for 377.

And yes Indian law is too slow to change.

Because it's still not socially acceptable and they're probably scared to lose their fans (IMHO fans who stop liking someone just because they choose to love someone of the same gender, aren't really fans anyway). A big part of the population is uneducated when it comes to sexuality. I've seen so many people call KJo namard just because he's gay. -.-

And if the disgusting comments many BW actresses get on their SM weren't enough, imagine how worse it'd get if they admitted to being bi or lesbian?

I wish it wasn't that way tho. No one should be ashamed of who they love or have to fear being publicly mocked because of it.

I also believe that it's a v personal thing and people should refrain from making assumptions about someone else's sexuality cuz it's their business and their business only.

^I know that what I just wrote isn't really clear and quite random but I'm in one of my ranty moods rn + sleepy af.

Well, since long there have been attempts to criminalize the clients engaging with Prostitutes but that has always been opppsed ny the Health Ministry. So, i woukd say no they cannot be penalksed for that. However, one can charge them for engaging in such an act in proximity to a public place etc.

Well, every law has pros and cons. And, there is no denying the fact that wives have invoked section 377 in numerous cases against their husband.
Marital Rape is an issue which will take a lot of time to get solved because even the law recognizes sex as the part and parcel of marriage. If a partner continously denies sex, then it amounts to mental cruelty and is a valid ground for divorce.
