Drunk driving is a serious offense that risks the lives of many innocents. Getting caught drunk driving itself should have severe penalty so that people will think twice before doing so. Killing someone due to DUI should deserve a sentence more than a mere eighteen months. At the same time I still believe a line should be drawn between murder and reckless homicide. Drunk drivers are stupid idiots who should be severely punished not malicious criminals who consciously want to inflict harm upon people.

DUI is merely one aspect of the dangers on the road.But what about sleep deprived driving, talking on cellphone, driving after taking prescriptions which specifically prohibit operations of machine all the crap people do in cars. Killing someone due to any sort of negligence while driving should be treated the same - 'someone was killed'

drinking and driving is a very common thing in india..happens almost every hour and is let go more easily than anywhere else in the whole world.

Drinking and Driving is equal to muder and the word "accident" used is a misnomer..since accidents happen by mistake and drunken drivers do know the consequences..and thus they shud be severely punished!! I totally mean it..severely punished .If they are prisoned for 18 months they mite not do that for another 2 months but would soon get back to what they were doing.

In India more accidents are caused buy careless driving (more than drunken driving) by youngeters, aged in between 18 and 25. Most of them drive City buses(in Kerala) correctly named red killers, trailers and bulk careers and then get into acceidents and cause for death(daily one or two in the news papers), and get out after paying Rs3000/- or something as fine in the Court, eveif there is death occure. What is the remedy for it?

Well i agree that 50% of the accidents occur due to careless driving and the rest 50 % by drunken people..! i could possibly take a place like mumbai where the night life is long..young guys and gals between 16-18 yrs get drunk and cause harm to a lot of innocent people..and it happens more than often there..since i myself have seen such accidents happening when i go out for a stroll in the night...These kids who are most probably sons/daughters of rich kids get out my giving money...even if the law is against bribing all that happens in the police office and gvt office is bribing ..THATS IT.The only remedy is reforms in our system..and enforcment of law in an extremely strict manner so that noone takes the police or laws as a game..!!!

A sober person knows the consequences of driving drunk. An inebriated person is knows the consequences but acts with impaired thinking. Murder requires a motive and intent to kill somebody. A drunk driver does not intend to kill anybody nor do they have the motive. We simply cannot mesh the two together on the principle that defines murder.

Is it homicide? Yes a person was killed. There maybe no motive or intent but the drunk driver committed the act of killing and hence is guilty of homicide punishable to the full extent of law under homicide.
