@determination thanks for making this post. Yes for me too Samay is the voice of truth. I went through his testimony twice because it was that beautiful. Believe me when he entered the court I just felt like Krishna walking in MB. 😆. First Piyush is doing a very good job as Samay and creatives have really written his dialogues well.
What I concluded from his testimony was ( if I take that testimony as truth ). What Ayan did to Maya was physical assault. But Maya felt it was attempt to rape.

Ayan should have been punished for physical assault and intimidation. It should not have been brushed off like Saanjh said. Any brother would have done it.

Maya when she put the keys in the blouse might have thought Ayan would not touch her. Her feelings were true when she spoke as the Goddess of Justice was shown.

Path should have been from Samay's truth to Maya's feelings and her feelings should have been corrected and she punished for her offence. That's taking Arjun. And Ayan for his offence, that is physical assault and intimidation.But we travelled from Maya's feelings to Samay's truth which ended up in Ayan getting punished in wrong category and Maya going scott free.

Coming back to the post- I felt samay, while making friendship with sanjh, knew her to be maya's husband's friend
and thus makes him a suspicious character to me

how does the lawyer know that it was sanjh who had suggested him to be away from the case?

if you feel that samay can come to aayan's rescue, it is good, but I have complete doubt on him

I also find him (especially his smirks) suspicious in many scenes.

@Blue: To be very frank, I don't think he'll aid Ayaan [At least, till he is absolutely sure that Maya framed the latter, which is not a proven fact till now. Even, if he gets to know that Maya willingly implicated Ayaan, he may not play an active role and may leave both parties to fight their own battles. Herein, I am just speculating. It may turn out to be a completely baseless conjecture].

To be very truthful and this interpretation comes only after watching yesterday's (Monday's) episode, I am not sure any more whether Ayaan is guilty of battery. But, he is definitely guilty of criminal intimidation.

Firstly, on the charge of battery, of course, Ayaan cannot legally take the excuse of 'intoxication' as it was voluntary intoxication.

However, even before one talks about applying exceptions, the two elements of the crime (mental and physical) have to be proved.

For every crime, intention to cause the same has to be proved. I don't really know whether Ayaan at that moment (at the crime scene) had any intention to cause assault or battery. (He definitely did have an intention to intimidate Maya).

As it is difficult to prove one's mental state, I guess a good lawyer, in such a case, can prove Ayaan's intention or lack thereof, through circumstantial evidence only.

I, however, at this moment, have started thinking that maybe Ayaan's act did not cause any injury, fear or even annoyance in Maya's mind (as she was really prepared for Ayaan). Maybe, Ayaan did not even aim to cause the same.

On the other hand, I guess we can argue that even if Ayaan had no intention to cause injury/fear/annoyance, he had the knowledge that his actions would in likelihood cause such injury/fear/annoyance - so, the mens rea element is fulfilled.

I guess Ayaan could still not be held liable for battery as he could successfully take the defense of 'grave and sudden provocation' (provided Ayaan had a more competent Counsel for Defense).

Finally, the lesson I learn from each court room drama shown on every daily soap (including the one shown on 'Beyhadh') is that do not expect the CVs to do their research on Indian laws, even preliminary research is beyond their scope😉. However, Samay's testimony was still one of the best executed ones on television till date (in terms of legal clarity only and not the drama quotient).

@determination if I look at the way the whole case was conducted there were many flaws. If I get into that , that itself will fill the space.
I was only interested to be frank on Samay's entry and his testimony. Because I knew if anything holds water that is his testimony😆.

I feel any intelligent lawyer would have managed to get Ayan out if he or she have used Samay correctly. Even after yesterday episode Maya kicked Ayan and he fell on her, but he did tear her dress apart and held her hair too. That happened voulntary.

@Blue: I feel exactly the same.

@Red: For me, both Samay and Maya's mother could be important witnesses (Well I hope so about the latter).

@Yellow: That's my favourite issue (topic of discussion with my friends) - the misuse of a good opportunity by the Defense lawyer.

@Green: You've got a good point. That's one reason why I used terms like "not sure any more" and "have started thinking" (I am not convinced wholly that Maya framed Ayaan totally. I need more PROOF).

Jhanvi is there. But I didnt count on her for this case because she cannot move on her own or speak and I was not expecting a dramatic entry from her 😆😆

Yes, you guesses right.


Samay, for me, more than being a suspicious character is actually a confusing character.

On the one hand, he is this Gandhivaadi, philosophical guy, who my Mom while teasing me yesterday, addressed as a young woman's 'dream'😉 (after watching one or two selected scenes), because he portrays a mature, understanding nature, a quality found rarely in today's youth.

But, then he kind of shares secret looks with Maya or smirks and I am back to drooling as well as wondering what his real motive is.

All of this does make me question whether the CVs have themselves made up their minds on whether to go the Desi Collings way with Samay's character, or to make him a mastermind (as I initially hoped he would be).

Knowing about Jhanvi's condition, I was hoping (against hope) that she would be able to give some clue (by some other means of communication) to Arjun so that he delves deeper/starts investigating. [I kind of had this hope after seeing the bonding that this duo (Arjun-Jhanvi) share.]

To be truthful, I am still waiting for Jhanvi to do something by the time the case reaches the Appellate Court, assuming that it will (which it most probably won't).

I guess I'm expecting some miracle. You know Hope Springs Eternal...
