Underage trace : a loophole?

Its stated in HBP that ministry can't distinguish who perform the magic in a house. So pure/half blood kid can do magic in their homes & ministry will think it's their parents but mudbloods & kids like harry/voldy cant do it undetected! Isnt it a loophole?
