I had thought something similar to what you said but not based on evidence.
I thought since Siddhi was the one driving and she did give warnings (not threat per se) to Rohit, may be all Kunal can do is prove it was an accident, not murder. But Thakral sure can gather proof against Kunal and present it in next hearing. Here Kunal can say well he wasn't driving the car it was just his trick. But given when Kunal said he was driving, Thakral was able to gather FAKE evidence to convict Kunal. So how can court be sure if the evidences against Siddhi are 100% valid and Thakral did not produce it using his power and influence.
So really all Thakral wants is settle a personal grudge and that is why he is making an accident into murder. So this was my approach as Siddhi did do an accident. But then again, Rohit is alive so there would be new twist to this.

Well I am not directly related to legal field, but I do know something called burden of proof. Usually burden of proof lies on prosecution. So Thakral has to prove that Siddhi is guilty, Kunal doesn't need to prove that Siddhi is innocent. So really what Kunal needs to do is question so called evidences in reasonable manner and ponder if they are enough to convict beyond reasonable doubt.

Again don't know how legal system really works, but based on my study; this is what I know. Of course it would be ideal if CVs do their homework properly and I hope this time they do as said by Sameer sir.

But let's say Thakral does accumulate FAKE evidences against Kunal; but Kunal can present plenty of eye-witness to show he was actually at home. So in that case raise doubt on Thakral and as you said it would be contempt of the court for presenting false evidences. So right now even if Kunal doesn't do anything; he still has some ground to stand on.

But yes I do hope that Kunal has acknowledged what Richa said and Thakral coming to their house also indicates that he is planning something big. But at least we are seeing some kind of investigation as it is much much needed.

What I wonder is, Rohit being alive going to come in place now or it may take some time?
