They chose 5 year’s leap for a reason. According to IPC if a partner stays separate knowingly and don’t contact the other and the other gets married during that period without applying for divorce they will be granted divorce and the marriage happened during that time get legal status. And here Sai not only hid herself she didn’t contact Virat and told she is alive. So, if Pakhi goes to court fearing for legality of her marriage she immediately gets legal status and declare Sairat as divorced.

Its a grey area..Virat on the other hand never looked for her and just based on a piece of cloth he believed that sai is dead..Then he went ahead with the marriage...

Mpre importantly this adoption is illegal...

Adoption was not illegal as they adopted him from orphanage and then Sai claimed her motherly rights but then Sai backed out for well-being of Vinu’s mental health so now even though it’s illegal because Sai is not claiming her rights legally we have to bare the drama. And we have to accept this P claiming he mother rights over Vinu.

adoption was illegal by all means.. Virat didn't have to marry anyone to adopt a boy child... Any institution can not impose their own law.. I think that is as per cara regulation..

More importantly sai did not give up her son to begin with .he was lost and then found in orphanage ..p has no rights over Vinu except she is only a care giver.. Sai has not give up her son rather she only asked to keep him away from court..

patralekha is a third person., she cannot file for the divorce of Sai n virat

if Sai n Virat have stayed separately they will be granted immediate divorce .. but for that they have to go to court and file for divorce .. sitting in the house they cannot say divorce..

After that divorce .. virat can marry Pakhi

if after knowing that Sai is alive if virat had gone to the lawyer and filed a case on court .. got his first marriage dissolved.. and then married P as per pheres .. tab shadi valid hoti

But they did not show any flashback of divorce .. Infact during Vinayak custody they mentioned our relationship has reached the court now .. matlab their marriage never went to court before

now they cannot file for divorce .. because Sai n virat are cohabiting in the same residence after years living apart . Court does not go to the room and check ..even after years of living apart now they have started living in the same house . They cannot be granted immediate divorce .. court will give them 6 months ..to try n settle matters .
